2.36.010 Circuit court--County work release program.

The county work release program is operated under the jurisdiction of the Vanderburgh County Sheriff.

2.36.020 Superior court--Drug and alcohol deferral service.

The drug and alcohol deferral service is operated as a separate agency under the jurisdiction of the Vanderburgh County superior court.

2.36.030 Court employees--Wages, hours and recordkeeping.

A.    Employee attendance reports will be kept on State Form 14304 (R2/12-87)/Form A-4 (Rev. 1987) as to all full-time employees who are neither office holders nor executive employees. The courts and commissioners understand that the full-time employees will work a two thousand eighty (2,080) hour work year, including credit for vacations, sick leave, compensatory time off and personal days as determined by the judges. The records of hours worked will be figured on the basis of hours worked as defined under the Fair Labor Standard Act and regulations promulgated in furtherance of that act.

B.    The commissioners and the courts understand that the salaries of public defenders and other heretofore recognized part-time employees are not reckoned on the basis of a two thousand eighty (2,080) hour work year, nor will the State Board of Accounts Employee Attendance Report forms be required to be kept in regard to those employees.

C.    The courts and commissioners agree that the courts have the express full and absolute right to determine their own office hours as set forth in IC 33-13-12-11.

D.    The commissioners and the courts mutually agree that the courts have the authority to determine their own personnel policies by virtue of their unique responsibilities, administrative needs, and special powers granted as judicial officers of the state.

2.36.040 Powers and duties of the Board.

The Board shall have the following powers and duties:

Prepare a comprehensive plan for providing legal representation to indigent defendants/respondents in Vanderburgh County in accordance with IC 33-9-15-5. The comprehensive plan shall, at a minimum, provide for:

1.    legal representation to an indigent defendant/respondent at the earliest possible point in time;

2.    legal representation to an indigent defendant/respondent by the same attorney or attorneys through the pendency of the matter to the greatest extent possible;

3.    professional development, continuing legal education, and malpractice coverage for public defenders; and

Establish policies and procedure for the provision of competent legal representation for indigent defendants/respondents in criminal, juvenile, probation violation, extradition, child support and criminal contempt, and other matters pursuant to the comprehensive plan.

Establish guidelines and procedures for the determination of indigency and for the appropriate reimbursement for legal representation provided at public expense in accordance with IC 33-9-11.5.

Recommend an annual operating budget for the Agency and monitor the expenditures of funds.

Prepare and submit to the Vanderburgh County Council and the general public an annual report on the operation of the Agency.
