12.24.010 Rules and regulations.
It shall be a violation for any person to do any of the following in or upon the grounds or facilities of any Vanderburgh County Park (“County Park”) without the express permission of the Board of Commissioners of Vanderburgh County (“Board”) or the County Parks Manager:
A. Canvass or solicit any contribution or vend, sell, peddle, or offer for sale any goods or activities on County Park property.
B. Bring or allow any animal to go onto County Park property, with the exception that a person may bring a cat or dog on County Park property if the animal is under the absolute control of such person and is constantly maintained on a lease.
C. Paste, glue, tack or otherwise post any sign, placard, advertisement, or inscription whatsoever or erect or cause to be erected any sign whatsoever on any public land or highways or roads in or adjacent to a County Park.
D. Dig or remove any soil, rocks, sand, stone, trees, shrubs, plants, or other wood or materials or make any excavation by took, equipment, blasting or other means of agents on County Park property.
E. Damage, cut/carve, mark, transplant, or remove any plant or injure the bark or pick flowers or seeds form any tree or plant, dig in or otherwise disturb grass areas, or in any other way injure the natural beauty or usefulness of County Park property.
F. Swim, bathe or wade in any waters or waterway in or adjacent to any County Park. However, such activity may be permitted in such waters and at such places as are specifically designated by the Board or County Park management.
G. Ice skate, sled or otherwise go upon the surface of any frozen lake, pond or other body of water within County Park boundaries.
H. Take any unauthorized boats, canoes or other watercraft upon any lake, pond or other body of water within County Park boundaries, except as specifically allowed by County Park management.
I. Kindle, build, maintain or use a fire, within a County Park except in places provided for such purposes. Any permitted fire shall be continuously under the care and direction of a competent adult from the time it is kindled until it is distinguished. No person shall throw away or discard any lighted match, cigar, cigarette, tobacco, paper or other material within or against any building, boat, or vehicle or under any tree or in any underbrush within any County Park.
J. Hunt, molest, harm, frighten, kill, trap, pursue, chase, tease, shoot, or throw missiles at any animal, wildlife, reptile, or bird; or remove or have in one’s possession the young of any wild animal or the eggs, nest, or young of any reptile or bird within any County Park.
K. Fish in any waters or waterways in or adjacent to any County Park, except in such waters and at such places as specifically designated by the Board or County Park management. Fishing after dark is not permitted within a County Park. Any person fishing within any County Park must comply with the rules and regulations adopted by the State of Indiana Division of Fish and Wildlife.
L. Willfully mark, deface, disfigure, injure, tamper with, displace, or remove any buildings, bridges, tables, benches, fireplaces, railings, paving or paving material, water lines, or other public utilities or parts or appurtenances thereof, signs, notices, or placards, whether temporary or permanent, monuments, stakes, posts, or other boundary markers, or other structures or equipment, facilities situated within County Park property or any appurtenances whatsoever, either real or personal.
M. Throw, discharge, or otherwise place or cause to be placed in the waters of any fountain, pond, lake, stream, bay or other body of water in or adjacent to any County Park, or any tributary stream, storm sewer, or drain flowing into such waters any substance, matter or thing, liquid or solid, which will or may result in the pollution of said water.
N. Bring glass beverage containers onto any County Park property.
O. Be or remain on or in County Park property between the hours of 12:00 midnight and 7:00 a.m. the following day unless such person is leasing a Burdette Park Chalet or other facility or unless such person is engaged in activities directly supervised by County Park personnel acting with the scope of their employment.
P. Sell or offer for sale any alcoholic beverage in or upon County Park property.
Q. Drive any vehicle on any area except paved County Park roads or parking areas or leave a vehicle standing or parked in established parking areas or elsewhere in a County Park during hours when the facility is closed.
R. Endanger the safety of any person within a County Park by any act or conduct.
S. Violate any rule or regulation imposed on behalf of any County Park, golf course, or pool, which rules and regulations may or may not be posted at the County Park, golf course, or pool, and which may be on file for public inspection at any County Park, in the office of the Board or in the office of the County Auditor.
T. Bring into or have in one’s possession in or on any County Park property any pistol, revolver, or object from which loaded or blank cartridges may be used, or any rifle, shotgun, BB-gun, air gun, spring-gun, slingshot, bow, or other weapon in which the propelling force is gunpowder or spring or air.
U. Bring into, have in one’s possession, or set off any fireworks in or upon any County Park property.
12.24.020 Lease of facilities.
A person who enters into a lease agreement with Vanderburgh County or a County Park for the rental of a chalet, shelter or any other facility, item or property within any County Park shall abide by all terms, conditions, rules and regulations pertaining to such lease.
12.24.030 Park rules.
Rules may be posted in appropriate areas in and around County Park property. All persons utilizing a County Park and/or County Park facilities shall comply with and abide by all posted rules. A copy of all such rules are available in the Board of Commissioners Office of Vanderburgh County, the Vanderburgh County Auditor’s and the Burdette Park office. County Park hours are from 7:00 a.m. until 12:00 midnight. Failure to comply with this ordinance shall subject the offender to the penalties set forth in Section 10.99 of the Vanderburgh County Code.
12.24.040 Enforcement of rules and regulations.
All County Parks shall be operated and maintained under the supervision of the Board of Commissioners of Vanderburgh County pursuant to §31.39 of the Vanderburgh County Code. The Vanderburgh County Sheriff’s Department, the Board and County Parks Manager, as well as the County Park’s employees and agents shall, in connection with the duties imposed by law, diligently enforce the provisions of this subchapter. A violation of any of the prohibitions in the section shall be a violation of this subchapter and shall be punishable pursuant to §10.99. A separate offense shall be deemed to have been committed on each day during or upon which a violation occurs or continues.
