ARTICLE I. IN GENERAL
62-1 Open burning prohibited; penalties; appearance tickets.
(a) As used in this Code, the term “open burning” is defined as any fire or combustion producing visible smoke for purposes of disposal or reclamation from which the products of combustion are emitted into the open air without passing through a stack, flue or chimney which has been approved by the air pollution control commission, state department of public health, excepting therefrom any burning permitted by state law.
(b) Open burning is prohibited in the city, and any person who shall cause, permit or maintain open burning in the city shall be guilty of a violation of this section.
(c) Any person who shall violate the provisions of this section shall, upon conviction thereof, be punished in accordance with section 1-25 of this Code and/or by any civil remedies available to the city.
(d) In addition to the usual means of enforcement of the ordinances of the city, any police officer of the city, any member of the fire prevention bureau of the city fire department, or any building or housing inspector duly employed by the city shall be authorized to issue and serve appearance tickets charging violations of this section.
