ARTICLE II. JUNKYARDS1

32-19. Definitions.

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Junk dealers means any person, corporation or members of a copartnership or firm whose principal business is that of purchasing, selling, exchanging, storing or receiving secondhand articles of any kind, cast iron, old iron, old steel, excepting nonferrous materials, tool steel or tools, lighting and plumbing fixtures or dismantling, wrecking and disposing of the junk and/or refuse material of automobiles, is hereby defined to be a secondhand or junk dealer.

Junkyard means the place of business in or about which such operation is carried on is hereby defined to be a junkyard within the terms of this article.

32-20. Regulations.

(a) Hours of operation.

(1)    Open to public. No junkyard or secondhand store shall be open to the public for transaction of business before the hour of 7:00 a.m. or remain open later than 9:00 p.m. and shall be closed all day Sunday.

(2)    Burning and metal reduction. All burning, smelting, rendering or reducing by heat shall be commenced between the hours of 6:00 a.m. and 9:00 a.m. on Tuesdays through Fridays and shall be done in compliance with fire and health regulations.

(b) Purchase restrictions. No applicant under the provisions of this article shall purchase anything whatsoever from:

(1)    Any person who is at the time intoxicated;

(2)    A habitual drunkard;

(3)    Any person known to him to be a thief or an associate of thieves or a receiver of stolen property; or

(4)    Any minor under the age of 17 years or from any person he has reason to suspect of being such.

(c) Appearance. Every applicant licensed under the provisions of this article shall keep and maintain said junkyard in a reasonably neat, orderly and compact arrangement to the end that the contents of said yard shall not present an unsightly appearance from any adjoining road or highway or from any adjoining residence.

(d) Reports or statements. Every applicant licensed under the provisions of this article shall comply with all requirements with respect to reports or statements required by statute or local resolution governing the conduct of said yard or business.
