GENERAL PENALTY

1.12.010 General penalty.
A. Any person violating any of the provisions of or failing to comply with any of the mandatory requirements of any ordinance of the town is guilty of a misdemeanor, except for those ordinances or code sections which specifically provide that violations thereof are municipal infractions subject to the provisions of Sections 7-1-4150 through 7-1-4152, MCA. Unless different punishment is prescribed by any ordinance of the town, any person convicted of a misdemeanor under the ordinances of the town shall be punished by a fine of not more than five hundred dollars. No prison term shall be imposed for violations referred to in this subsection. It is the intent of the town council that its legislative purpose in this subsection is to impose absolute liability for the violations described herein.
B. Each such person is guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinances of the town is committed, continued or permitted by any such person, and he or she is punishable accordingly. 1.12.020 Municipal infractions.
The town council may designate by ordinance that violations of particular sections, chapters or titles of this code constitute municipal infractions that are subject to the provisions of Sections 7-1-4150 through 7-1-4152, MCA, and as later amended, and other applicable statutes. the town council shall by resolution authorize specified town officers or employees to enforce and issue citations for violations of town ordinances that constitute municipal infractions.
