8.28.010 Madison Addition--Private wells prohibited--Exception.
A. It is unlawful for any person, firm, corporation or association to drill, dig, construct or otherwise put into operation any private water well in the Madison Addition. Violation of this section is a municipal infraction subject to the provisions of Sections 7-1-4150 through 7-1-4152, MCA.
B. This section shall not apply to any wells provided under the town water rate, which are or shall become a part of the town water utility.
C. Any person attempting to drill any well in violation of this section shall be subject to an immediate stop order to be issued by the town building official. The owner may appeal such administrative order to the town council within ten days of its personal service upon him. The decision of the town council, acting as an appeals board in such instances, shall be final. (Ord. 207 §24, 2000; Ord. 166, 1994)
