2.36.010 Authority.

NRS 245.210 requires the enactment of an ordinance providing for annual, sick and disability leave for elected and appointed county officers and county employees. (Ord. 8-18-77 § 1(1))

2.36.020 Definitions—Applicability.

A. For the purpose of this chapter, the terms “elected officers” and “employees” shall embrace all officers duly elected or appointed according to the law of the state and the ordinances of the county, for which provision for compensation has been made by law, and all employees of any elected or appointed officer of the county or a department thereof. The term “elected officers” includes those appointed to fill a vacancy existing in an elective office.

B. Nothing in this chapter shall be construed as applying to or in any way affecting the officials or employees of the Humboldt County school district nor the Humboldt County hospital. (Ord. 8-18-77 § 1(2))

2.36.030 Annual leave.

A. First Five Years of Service. During the first five years of service with the county, all employees of the county, including elected and appointed officers, shall be entitled to annual leave with pay of one working day for each month of service. During the first six months of employment, annual leave accrues as provided above but cannot be taken during this period. Part-time employees shall be entitled to prorated annual leave, based upon the ratio of the hours worked per week to a normal workweek. Unused annual leave shall not accumulate in excess of twenty-four days at any one time. Unused annual leave which exceeds twenty-four days shall be lost and the employee shall not be compensated therefor.

B. After Five Years of Service. At the conclusion of five years of service, each employee, including elected and appointed officers, shall be entitled to annual leave with pay of one and one-quarter working days for each month of service. Part-time employees shall be entitled to prorated annual leave based upon the ratio of the hours worked per week to a normal workweek. Unused annual leave shall not accumulate in excess of thirty working days at any one time. Unused annual leave which exceeds thirty days shall be lost and the employee shall not be compensated therefor.

C. After Fifteen Years of Service. At the conclusion of fifteen years of service, each employee, including elected and appointed officers, shall be entitled to annual leave with pay of one and two-thirds working days for each month of service. Part-time employees shall be entitled to prorated annual leave, based upon the ratio of the hours worked per week to a normal workweek. Unused annual leave shall not accumulate in excess of forty working days at any one time. Unused annual leave which exceed forty days shall be lost and the employee shall not be compensated therefor.

D. Long-Term Employees. The board of county commissioners may, by order duly entered upon its minutes, provide for additional annual leave for long-term appointed officers and employees.

E. Death of Employee. In the event an appointed officer or employee dies and was entitled to annual leave under the provisions of this chapter, the heirs of such deceased officer or employee who are given priority to succeed to his assets under the laws of intestate succession of the state, or the executor or administrator of his estate, upon submitting satisfactory proof to the board of county commissioners of their entitlement, shall be paid an amount of money equal to the number of days of earned or accrued annual leave multiplied by the daily salary or wage of such deceased officer or employee.

F. Designation of Beneficiary. If the employee has filed a written designation of beneficiary, the final payment of compensation due a deceased employee is not his property or that of his estate but shall be released to the designated beneficiary upon the written request of such beneficiary.

G. Termination of Employee. In the event an appointed officer or employee, but not an elected officer or a person appointed to fill a vacancy in an elective position, terminates his employment for any reason and is entitled to annual leave under the provisions of this chapter, he shall be paid an amount of money equal to the number of days of earned or accrued annual leave multiplied by the daily salary or wage of such appointed officer or employee. However, an appointed officer or employee must not be paid for accumulated annual leave upon termination of employment unless he has been employed for six months or more.

H. Leave of Absence. Any appointed officer or employee may be granted a leave of absence without pay. (Amended during codification; Ord. 8-18-77 § 1(3))

2.36.040 Sick leave.

A. Amount Granted. All elected and appointed officers and employees shall be entitled to sick and disability leave with pay of one and one-quarter working days for each month of service, which may be accumulated from year to year, not to exceed ninety working days. Part-time employees shall be entitled to disability leave based upon the ratio of the hours per week to a normal workweek.

B. Family Illness or Death. Sick leave may be allowed for an illness, out-of-town medical appointment or for a death to a member of the immediate family of the employee not to exceed five days subject to the approval of the department head.

C. Long-Term Employees. Notwithstanding the provisions of this section, the board of county commissioners may by order duly entered upon its minutes provide for additional sick and disability leave for long-term employees. (Ord. 8-18-77 § 1(4))

2.36.050 Allocation of entitlement to annual and sick leave.

Annual leave to be earned during the coming year will be credited at the beginning of each calendar year. The employee will then work against that balance throughout the year. In the event of termination, annual leave used beyond the amount earned to date of termination would be deducted from the final paycheck. Sick leave will be allocated on a monthly basis as earned, that is one and one-quarter days sick leave shall be added to the employee’s entitlement at the end of each calendar month employed. Annual leave and sick leave will be determined on a calendar-year basis. (Ord. 8-18-77 § 1(5))

2.36.060 Restoration of lost sick leave or annual leave.

In the event an employee or official shall have lost either sick leave or annual leave because of exceeding the maximum but shall in the future be required to use all his or her entitlement due to serious injury or illness, the board of county commissioners may, but is not required to do so, reinstate any portion of such lost sick leave or annual leave. 2.36.070 Leave of absence.

Any appointed employee or officer upon written application to his supervisor may be granted leave of absence without pay, subject to the approval of the board of county commissioners. (Ord. 8-18-77 § 1(7))

2.36.080 Court duty.

No employee or official shall be docked any wage for serving as a juror or as a witness. If such employee or official receives a fee for such service, the fee shall be turned over to the county treasurer. However, the employee or official may retain any travel or expense reimbursement. (Ord. 8-18-77 § 1(8))

2.36.090 Compensatory or overtime.

No compensatory time or overtime shall be worked without first being approved by the department head or the board of county commissioners. All work beyond forty hours in a week for forty-hour employees or beyond thirty-five hours in a week for thirty-five-hour employees shall be overtime. Employees working overtime may be paid therefor on a straight time basis or accumulate the hours of overtime worked as comp time to a maximum of ten working days. The election between whether overtime is paid or comp time is accumulated shall rest with the department head. All overtime hours above ten working days’ accumulation shall be paid at straight time.
