AUCTIONS AND AUCTIONEERS

5.16.030 Character of applicant—Investigation.
5.16.010 License required.
It is unlawful for any person to conduct an auction in the county or to do business as an auctioneer, whether the goods sold are owned by the auctioneer or not, without having first obtained a license therefor as provided in this chapter. (Ord. 12-16-85A § 1(7.1))
5.16.020 License—Application.
Applications for auctioneers’ licenses, or for a single auction, shall:
A. Be made in writing to the county clerk on a form provided by the county clerk;
B. State thereon the place of business intended to be occupied, if any, or the place of such auction; and
C. Give the names of any employees, not to exceed two, who are to be authorized to conduct auctions under the authority of the license granted. (Ord. 12-16-85A § 1(7.2))
5.16.030 Character of applicant—Investigation.
No license shall be issued to a person other than a person of good character. The sheriff shall investigate the character of an applicant before the license is issued. (Ord. 12-16-85A § 1(7.3))
5.16.040 Exemptions.
Nothing in this chapter applies to any public auction or sale made or conducted by a public officer by virtue of any judicial order or process or by virtue of any power or authority contained in a mortgage or trust deed. (Ord. 12-16-85A § 1(7.4))
