13.24.010 Created.
The district was created by the board of county commissioners by resolution passed and adopted June 21, 1965, in accordance with then-existing law. Thereafter the district was renamed the Paradise Valley sewer district, state law was amended to provide for creation of five-person elected boards for all sewer and sanitary districts, the board of county commissioners regularly appointed the first board of trustees and thereafter the board has been elected pursuant to statute, bond counsel for the various sewer districts ruled on May 21, 1973, that the district was duly created and organized, various petitions for exclusion from and inclusion in the district have been filled and hearings held thereon and orders entered in accordance with statute. The district exists under the authority of NRS Chapter 318. (Ord. 8-07-06; Ord. 4-15-76 § 1)
13.24.020 Boundaries.
The Paradise Valley sewer district consists of the following described property in and around the town of Paradise:
All of Blocks A through N and Kemler Block of the town of Paradise Valley, as shown on the official map of the Town of Paradise Valley by C.E. O’Leary, County Surveyor, 1934, on file in the Humboldt County Recorder’s Office and the following additional areas;
Beginning at the southwest corner of Block A of the said Town of Paradise Valley thence West 230', thence South 380', thence East 250', thence North 380' to the point of beginning.
Beginning at the southwest corner of Block D of the said Town of Paradise Valley thence South 80', thence East 280', thence South 825.5', thence East 213', thence South 21', thence East 77', thence South 150', thence East 230', thence North 1076.5', thence West 700' to the point of beginning.
Beginning at the southwest corner of Block K of the said Town of Paradise Valley thence South 1075', thence East 380', thence North 1074’, thence West 380' to the point of beginning.
Beginning at a point on Cottonwood Creek at the East end of the Bridge crossing said creek at Bridge Street in said Town of Paradise Valley and running thence East 50', thence South to said creek thence following the east bank of said creek to the place of beginning.
Beginning at a point 50' east from the east side of the bridge crossing Cottonwood Creek at Bridge Street in the said Town of Paradise Valley, and running thence South to the center of the natural bed of the said Cottonwood Creek, running thence in a southeasterly direction along the said center of Cottonwood Creek to the south-westerly boundary of the lot called Parcel 3 hereinafter described, thence north along the westerly boundary line of said Parcel 3 to the south side of Bridge Street in said Town of Paradise Valley and running thence west along the south side of said Bridge Street a distance of 50' to the place of beginning.
Beginning at a point 100' east from the east side of the Bridge crossing Cottonwood Creek at Bridge Street in said Town of Paradise Valley and running thence 40’ east along the south side of Bridge Street, thence South to the center of the natural bed of the said Cottonwood Creek, thence west a distance of 40’, thence north to the point of beginning.
Beginning at a point 140' east from the east side of the Bridge crossing Cottonwood Creek at Bridge Street in said Town of Paradise Valley, running thence east along the south side of Bridge Street 36'9” to the Northwest corner of Odd Fellows Hall; thence South along west side of the said hall to the northerly bank of Cottonwood Creek, thence westerly along said northern bank of the creek to a point adjoining Parcel 3; thence north to the place of beginning.
Together with any and all improvements situated on the above described premises.

13.24.030 Authority.
The district is formed for and is granted the basic powers provided in NRS 318.140, and all powers incidental thereto including, but not limited to, those in NRS Chapter 318. (Ord. 8-07-06)
13.24.040 Connections to sewer system required.
It is required that all owners of inhabited property in the district use the district’s system for collection and disposal of sewage by connection with the district’s sewer system if a service line is brought by the district to a point within four hundred feet of his dwelling place, and upon failure of a property owner to so connect within sixty days after written notice mailed by the district board, the board shall cause the connection to be made by other than the owner and cause a lien to be filed against the property for expense incurred in making such a connection by other than the owner. 13.24.045 Monthly service charge.
Every residence or establishment for which sewer service is required by this chapter shall pay a flat rate per month in accordance with the following schedules:

B. Fee for Sewer Use Unit. Monthly fee per sewer use unit is two dollars and fifty cents for operation and maintenance and two dollars and sixty cents for debt retirement for a total of five dollars and ten cents.
C. Commercial and Other Services. Commercial and other services not properly falling into any of the above categories and services extending outside the district shall be subject to individual rate determination by the board of trustees.
D. Method of Payment. The board of trustees may provide for the payment of the foregoing fees on a quarterly basis or may provide that the same be collected with the real property taxes of the county. The sewer user may elect to have the foregoing fees collected with the real property taxes by giving written notice to the board of trustees of the Paradise Valley sewer district. (Ord. 4-15-76 § 4. 13.24.050 Design—Construction of new connections—Inflow sources.
No new connections shall be made to the Paradise Valley sewer system unless they are properly designed and constructed and meet the requirements of federal and state law as well as the code of the sewer district. In no case shall inflow sources including but not limited to roof leaders, cellars, yard and area drains, foundation drains, cooling water discharges, drains from springs and swampy areas, manhole covers, cross-connections from storm sewers and combined sewers, catch basins, storm waters, surface runoff, street wash waters or drainage be permitted to be connected to the sewer system. 13.24.060 Connection charge.
The charge for the connection of improved property within the territorial limits of the district sewage system shall be the sum of the following:
A. The actual cost to the district of constructing the line from the property line of customer to the district’s sewer main;
B. The following additional sum:
1. During calendar year 1977, two hundred dollars,
2. During calendar year 1978, three hundred dollars,
3. During calendar year 1979, four hundred dollars,
4. After January 1, 1980, five hundred dollars;
C. Services extending outside the district shall be subject to individual fee determination by the sewer board;
D. During calendar year 1976, if users do not hook up by the time of completion of construction of the Paradise Valley sewer system, the connection charge shall amount to only the actual cost to the district of constructing the line from the property line of the customer to the district’s sewer main;
E. There shall be no connection charge for any connection made or contracted for during construction of the 1976 Paradise Valley sewer project;
F. Connection charges are payable at the time of taking out a county building permit. (Ord. 4-15-76 § 5. Formerly 13.24.050.)
13.24.070 Rules and regulations.
The board of trustees shall have the power and duty to adopt and may from time to time amend rules and regulations for the operation of the Paradise Valley sewer system including, but not limited to, rules and regulations concerning the method of hooking up and the type of use of the sewer, so long as such rules and regulations are not in conflict with law, this chapter or EPA rules and regulations Section 35.905-11.
