Offenses Relating to Use of Property

9.25.010 Prohibited deposit of refuse in park containers.

A. For purposes of this section:

“Refuse” includes, but is not limited to, food, paper, cans, bottles, containers, and similar garbage, trash, rubbish and debris.

“Generated on the premises” means the refuse resulting from a person’s lawful use of the premises.

B. No person shall place or deposit, or cause to be placed or deposited in a trash container located in a City park, any refuse not generated on the premises of the park where the container is located.

C. Violation of this section constitutes a violation. [Ord. 601 § 25, 1990; 1981 Compilation § 4-4.25.]

9.25.020 Prohibited camping.

A. For purposes of this section:

“To camp” means to set up or to remain in or at a campsite.

“Campsite” means any place where any bedding, sleeping bag or other sleeping matter, or any stove or fire, is placed, established or maintained, whether or not such place incorporates the use of any tent, lean-to, shack or any other structure or any vehicle or part thereof.

B. Except by regulation of the City Council or by permit granted as provided in this section, it is unlawful to camp in or upon any sidewalk, street, alley, lane, or other public right-of-way, or under any bridgeway or viaduct, or in any park, public place, or other publicly owned property.

C. The City Recorder shall have the power to grant exemptions from the prohibition of this section upon written application being made 10 days in advance of the requested camping. Upon receipt of such written application, the City Recorder may either refuse permission for the requested camping, or may review the application for potential health, sanitation and safety concerns and grant or refuse the permission based on such review.

D. Nothing in this section shall be deemed to prohibit camping in Pioneer Park pursuant to park rules and regulations as presently constituted or hereafter amended.

E. Violation of this section constitutes a violation, and each day of prohibited camping constitutes a separate violation. [Ord. 601 § 26, 1990; 1981 Compilation § 4-4.26.]

9.25.030 Lodging.

A. No person shall lodge in a car, outbuilding or other place not intended for that purpose without permission of the owner or person entitled to the possession.

B. Violation of this section constitutes a Class C misdemeanor. [Ord. 601 § 27, 1990; 1981 Compilation § 4-4.27.]
