2.25.010 Manner of councilor appointment to committees.
The city council shall assign each councilor to one or more of the city advisory committees and/or ad hoc committee identified in this chapter. A second councilor may also be assigned to a city advisory committee if desired by the city council. The councilors assigned to the committees will act as the chairperson and will continue in that capacity for the term of their office as councilor. The councilor assigned to a particular city department shall be primarily responsible for recommending the person(s) to be appointed to the advisory or ad hoc committee affiliated with such department. The department head or supervisor of each department may be an ex officio member of the committee affiliated with that department if appointed by the city manager. The city manager shall be an ad hoc (nonvoting) member of each committee. [Ord. 12-822 § 2, 2012; Ord. 10-810 § 2, 2010]
2.25.020 Terms of office – Vacancy.
Except as otherwise provided in this chapter, each committee member will be appointed for a term, coinciding with the term of office of the chairperson or until their respective successors are appointed and qualified. Advisory committee terms will commence on January 1st and will end on termination of the chairperson’s tenure. Ad hoc committee will be appointed for a specific task and upon completion of that task the committee will be dissolved. Any vacancy in the committee will be filled by the city council for the unexpired term of the predecessor in office. [Ord. 12-822 § 2, 2012; Ord. 10-810 § 2, 2010]
2.25.030 Removal of committee members.
Notwithstanding anything contained in this chapter to the contrary, all committee members serve at the pleasure of the city council and may be removed at any time, for any reason, with or without prior notice. Without otherwise limiting the generality of the immediately preceding sentence, a committee member may be removed by the city council for any of the following reasons: (1) failure to attend three regular committee meetings; (2) commission of a felony; (3) incompetence; (4) failure to declare conflicts of interest; and/or (5) any other committee member acts of misconduct or nonperformance. 2.25.040 Committee duties – General.
Advisory committees will act as an advisory body to the city council. Ad hoc committees will be appointed for a specific task as outlined by the council. Upon completion of that task and reporting of the same to the council the committee may be dissolved. Each committee will operate at the direction of the city council and in conformance with, and subject to, this chapter, Oregon law, and any and all city rules, procedures, resolutions, and ordinances now in force and/or which may hereafter be created, amended, modified, enacted, or promulgated. The committees (and their members) have no authority to bind the city or represent to any person that the committees (or their members) may bind the city. The committees (or their members) have no authority to make expenditures on behalf of the city or to obligate the city for the payment of any sums of money, unless and until the city council has authorized such expenditures by appropriate ordinance or resolution (which ordinance or resolution will provide the administrative method by which funds will be drawn and expended).
Committees may make recommendations to the city manager as to the operation of the affiliated department, and to the maintenance, improvement, development, and periodic inspection of property connected with or related to the affiliated department or area of interest. Committee members will receive no compensation for the performance of their duties.
In addition to any other duties or responsibilities assigned to committee members under this chapter, each committee member must regularly attend his or her committee meetings and must notify the city recorder or chair when he or she will be unable to attend a committee meeting. In addition, if requested by the city council, one or more committee members will attend any city council meeting that relates to his or her committee matters or issues. Prior to each committee meeting, each committee member will review all pertinent written documents in preparation for deliberation and decision making. All committee recommendations and suggestions made to the city council will be in writing. [Ord. 12-822 § 2, 2012; Ord. 10-810 § 2, 2010]
2.25.050 Committee meetings.
Each advisory committee will meet at such times, dates, and places as may be deemed necessary or appropriate to carry out committee business. Ad hoc committees will meet upon call of the chairperson. All committee meetings will be held in accordance with applicable Oregon law. [Ord. 12-822 § 2, 2012; Ord. 10-810 § 2, 2010]
2.25.060 Minutes and reports.
Each committee secretary will keep an accurate record of all committee proceedings, including written minutes of all meetings. A copy of each meeting minutes will be delivered to the city recorder for filing. Committee minutes are a public record available for public inspection. At the request of the city council, the committee will prepare and deliver to the city council a written report summarizing all committee activities, actions, and matters before the committee and any other information requested by the city council. 2.25.070 Committee officers.
The councilor appointed to the committee will chair such committee (if two councilors are appointed to a particular committee, the councilors will choose which councilor will chair the committee). Each committee will, at its first meeting of each calendar year, elect a vice-chair and secretary. The vice-chair will be a voting committee member and will hold office at the pleasure of the committee. The secretary need not be a member of the committee. The secretary will receive no compensation but will be reimbursed for expenses authorized by the city council.
The chair will call committee meetings, preside at all meetings, and sign all correspondence on behalf of the committee. The vice-chair will perform the duties of the chair in the absence of the chair and such other duties as may be assigned by the chair from time to time. In the absence of the chair and vice-chair, the committee will elect a temporary chair for the particular meeting in question. [Ord. 12-822 § 2, 2012; Ord. 10-810 § 2, 2010]
2.25.080 Quorum and voting.
A majority of the committee members will constitute a quorum. A majority vote of a quorum will be necessary to act on any matter before the committee. [Ord. 12-822 § 2, 2012; Ord. 10-810 § 2, 2010]
2.25.090 Conflict of interest activities.
A committee member will not participate in any committee proceeding or action in which any of the following has a direct or substantial financial interest: (1) the committee member or the spouse, brother, sister, child, parent, father-in-law, mother-in-law of the committee member; (2) any business in which the committee member is then serving or has served within the previous two years; or (3) any business for which the committee member is negotiating or for which the committee member has an arrangement or understanding concerning prospective partnership or employment. Any actual or potential interest will be disclosed at the meeting of the committee where the action or proceeding is being taken. [Ord. 12-822 § 2, 2012; Ord. 10-810 § 2, 2010]
2.25.100 Staff to committees.
The city manager, city attorney, and other city staff requested by the committee will support the work of the committee. The city attorney will act as the committee’s legal advisor in the conduct of all hearings and matters. Notwithstanding anything contained in this chapter to the contrary, the committee must obtain the consent of the city council or city manager prior to requesting the assistance of the city attorney or other city staff. 2.25.110 Advisory committees.
There are hereby established the following advisory committees: (1) central administration committee; (2) cemetery committee; (3) airport committee. The following areas of interest will have ad hoc committees appointed when appropriate for consultation on specific subjects: (1) public works and construction; (2) public safety; (3) parks. 2.25.120 Central administration committee.
The central administration committee shall consist of one councilor, the city manager, and city clerk. In addition to matters such as administration, work production, office, and accounting procedures and safety, this committee may advise the city manager concerning related matters and issues associated with city administration including areas of each department. 2.25.130 Public works and construction projects committee.
Any ad hoc committee appointed shall consist of one councilor, the public works director and a maximum of four citizens who shall reside in the city of Burns. [Ord. 12-822 § 2, 2012; Ord. 10-810 § 2, 2010]
2.25.140 Cemetery committee.
The cemetery committee shall consist of one councilor, the city manager, and designees as provided for in BMC 2.45.010. The committee shall advise the city council on matters coming before it or requiring attention, including matters associated with operation, maintenance, and safety. 2.25.150 Airport committee.
The airport committee shall consist of a Burns city councilor; the airport manager; a representative from the Hines city council; a county commissioner or county resident; a representative from the Burns Paiute Tribe; a representative from the state; a representative of the Burns interagency fire and two additional nonvoting positions: one from a business based on the airport and one a pilot. 2.25.160 Public safety committee.
Any ad hoc committee appointed shall consist of one councilor, the police chief or his designee, the fire chief or his designee and a maximum of four citizens who shall reside in the city of Burns. [Ord. 12-822 § 2, 2012; Ord. 10-810 § 2, 2010]
