URBAN RENEWAL AGENCY

2.32.010 Need declared.
Pursuant to ORS 457.035, the city council declares that blighted areas now exist in the city and that there is currently a need for an urban renewal agency to function in the city. [Ord. 21-876 § 2 (Exh. A), 2021]
2.32.020 Title.
The urban renewal agency created by this chapter shall be known as the Burns urban renewal agency. [Ord. 21-876 § 2 (Exh. A), 2021]
2.32.030 Membership and compensation.
(1) The urban renewal agency shall consist of the same members as the city council.
(2) Urban renewal agency members shall receive no compensation. [Ord. 21-876 § 2 (Exh. A), 2021]
2.32.030 Terms of office.
The terms of office shall be the same as that for the city council. The replacement of members is the same as for the city council. [Ord. 21-876 § 2 (Exh. A), 2021]
2.32.040 Election of chairperson and vice-chairperson.
The agency at its first meeting shall elect a chairperson and vice-chairperson who shall hold office at the pleasure of the agency. [Ord. 21-876 § 2 (Exh. A), 2021]
2.32.050 Appointment and duties of agency secretary.
The city shall appoint a secretary who shall not be a member of the agency. The secretary shall keep an accurate record of all agency proceedings. The agency shall, monthly, make and file a report of all its transactions with the city council. Decisions of the commission shall be filed with the city clerk immediately, when final. 2.32.060 Meetings and rules.
(1) A majority of the agency members shall constitute a quorum. The agency shall make and alter rules and regulations for its government and procedure consistent with laws of this state and with the City Charter and ordinances. The agency shall meet at least once each month, at such time and place as may be fixed by the agency.
(2) Special meetings may be called at any time by the chairperson or by three members by actual notice served upon each member of the agency at least 24 hours before the time specified for the proposed meeting. When time permits notice shall be written, and shall be given in such a manner as to provide actual notice. [Ord. 21-876 § 2 (Exh. A), 2021]
2.32.070 Duties and powers.
The agency shall have authority to exercise all powers available to the agency under ORS Chapter 457, including, but not limited to, the power of eminent domain. The powers conferred to this agency by ORS Chapter 457 are in addition and supplemental to the powers conferred by any other law. [Ord. 21-876 § 2 (Exh. A), 2021]
2.32.080 Limitation on action.
Any act of the agency shall be considered the act of the urban renewal agency only and shall not be considered an act of the city council, even though membership of both are identical. [Ord. 21-876 § 2 (Exh. A), 2021]
