3.16.010 Purpose.

The purpose of this chapter is to minimize the cost of police and fire services to the taxpayers of the city in cases in which the service is of a nonemergency nature and in which a specific benefit is derived by the person served or the service could have been avoided by the use of reasonable care on the part of the person served, by imposing the cost, or a portion thereof, upon the person served. 3.16.020 Definitions.

Unless the context requires otherwise, the following words shall be defined as follows in this chapter:

A. “User” means the person, persons or entity, including businesses, partnerships and corporations, to whom a service is provided.

B. “Service” means the provision of employee time, equipment or materials provided by the police department or fire department, in the manner specifically referred to in this chapter.

C. “Alarm business” means any business providing burglar, fire or any other alarm or warning systems within the city.

D. “Engine hour” refers to an hour, or any fraction thereof, that a fire engine is out of the fire station on a call. For the purposes of this chapter, engine hour shall be determined by the senior fire department employee responding to the call and shall be timed from the departure of the engine from the fire station to its return. 3.16.030 Police department charges.

The following charges shall be collected by the police department, in the manner specified, for the following described services:

A. Office Services.

B. Investigative Services.

Vehicle accident investigations occurring on private property (when no citation for traffic crime is issued)

Investigation of bad check cases on request of victim (where victim declines to prosecute or dismisses)

$10.00 for first check, $3.00 for each additional check

C. Response to Alarms.

1.

Owner or employee caused false alarm

First response $10.00; second response within three months $25.00; third response within six months $50.00; fourth response within one year $100.00; each additional response within one year $100.00

False alarm caused by faulty installation or defective equipment

First response $20.00; second response within three months $50.00; third response within six months $100.00; fourth and each subsequent response within one year $250.00 each

D. Special Duty Police Officers.

1. The compensation rate per officer, per hour, will be computed on an actual cost factor based on total services provided.

2. Total services provided includes, but is not limited to, current employee salaries and benefits, equipment usage, supervisory and administrative costs, etc.

3. The hourly compensation rate will be reviewed and adjusted if necessary each year by the finance director, in accordance with the criteria established by this section.

4. Authorization for usage of police personnel, staffing requirements, equipment usage, minimum-maximum assignment hours, etc., will be at the discretion and only upon approval of the chief of police. 3.16.040 Fire department charges.

The following charges shall be collected by the fire department, in the manner specified, for the following described services:

A. Office Services.

Copies of reports for insurance purposes

$5.00 for first page, $1.00 for each additional page

$25.00 commercial uses. No charge for residential use

B. Fire Safety Inspections and Weed Notices.

Commercial-industrial fire safety inspections

First inspection free; second inspection if problem uncorrected $25.00; third inspection if problem uncorrected $25.00

First notice free; second notice if problem uncorrected $25.00; third notice if problem uncorrected $50.00

C. Alarms and Responses.

1.

Water flow alarm activation or heat or smoke detector activation without fire and without prior notice to fire department

Activation of any type of alarm caused by incorrect installation or maintenance, without prior notice

D. Fire responses to incidents involving an airplane crash or an occurrence on a roadway, waterway or railroad right-of-way against which no taxes or assessments for fire protection are levied by the city shall be charged as follows:

The city may recover from the person who is the cause in fact of the incident any cost incurred that exceeds $400.00 based on the following State Standardized Cost Schedule:

Minimum response charge;

For each apparatus per hour or fraction thereof;

For each apparatus per hour following the first hour and prorated portions for each fraction of an hour after the first hour;

$10.00

Per hour (minimum charge one hour) for each person responding to and performing service at the scene of the emergency. This must be billed on a prorated basis after the first hour for any fractional hours of service.

E. Response to fire caused by stoves installed after April 1, 1978 without permit.

$200.00 per engine hour

F. Response to an unpermitted open burn; incinerator/burn barrel operating without a permit; incinerator/burn barrel with a permit, but operating in noncompliance with burning regulations.

3.16.050 Collection.

In the event of a failure by any user to pay for services rendered in accordance with the schedule of fees and charges contained herein, the police or fire department may refuse to provide the service requested or may request the city manager to commence appropriate proceedings for collection of such fees or charges. These remedies shall be nonexclusive and in addition to any other rights and remedies available under law. (Ord. 1969 §1(part), 2013; Ord. 1399 §1(part), 1980).
