TRESPASS--DESTRUCTION OF PROPERTY1

9.66.010 Entry on lands and refusal to depart.

A. Any person other than an officer on lawful business who goes or trespasses upon any enclosed lands or premises, or lands or premises the boundaries of which are delineated not his own, and upon oral, written or printed notice of the owner or the owner’s agent, or upon oral, written or printed notice of the person or entity in lawful occupation of the lands or premises, or his or its agent, fails or refuses to depart therefrom immediately and remain away until permitted to return, shall be punished upon conviction by a fine of not more than one hundred dollars.

B. Printed or written notices having attached thereto, by authority, the name of the owner or person in the lawful occupation of the lands or premises, and requiring all persons to forbear trespassing on the lands or premises and to depart therefrom, posted in three conspicuous places on the lands or premises is sufficient prima facie evidence of notice mentioned in subsection A of this section.

C. Any person who goes upon or in or trespasses upon or in or near any public school building or grounds owned or occupied by a public school district, where such person does not have any relationship of custody or relationship of responsibility for a student in attendance at such school is guilty of trespassing and upon conviction shall be punished by a fine of not more than one hundred dollars; provided however, that a necessary element of establishing a violation of this subsection shall be that the occupier of the school building or grounds, or its agent, officer or employee, or a peace officer shall have first given the person a request orally or in writing to remove himself and the person failed to forthwith remove himself. 9.66.020 Plants--Destruction.

It is unlawful for any person maliciously or wantonly to cut down, destroy or injure any flower, bush, shrub or tree standing or growing upon the property of another. (Ord. 306 §57, 1951).

9.66.030 Property--Destruction.

It is unlawful for any person maliciously to deface, injure or destroy any personal or real property of another. (Ord. 306 §60, 1951).
