CODE ADOPTION

1.01.010 Code adoption.
(1) The council of the city of Coos Bay finds that Code Publishing Company of Seattle, Washington, has compiled, edited, and published a codification of the permanent and general ordinances of the city of Coos Bay. Copies of the codified Coos Bay Municipal Code are now on file in the office of the Coos Bay city recorder for public inspection.
(2) The council hereby adopts the Coos Bay Municipal Code as the same was compiled, edited, and published by Code Publishing Company, as a codification of the permanent and general ordinances of the city of Coos Bay.
(3) The code shall be known as the “Coos Bay City Code” and it shall be sufficient to refer to it either as the “Coos Bay Municipal Code” or the “Coos Bay City Code” in any prosecution or adjudicative proceeding involving any provision of the code. This code should be cited as “CBMC” and specific sections should be cited as “CBMC 3.04.010.”
(4) It shall be sufficient from this point forward to designate any ordinance adding to, amending, correcting or repealing all or any part or portion of the code as “an addition to, amendment, correction or repeal” thereof. References may be made to the titles, chapters, sections, and subsections of the code and such references shall apply to those titles, chapters, sections or subsections as they appear in the code.
(5) Whenever a reference is made to the Coos Bay City Code or the Coos Bay Municipal Code or to any portion thereof, or any ordinance of the city codified therein, the reference is to apply to all amendments, corrections, and additions heretofore, now, or hereafter made.
(6) Title, chapter, and section headings contained in the code shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning, or intent of the provisions of any title, chapter, or section of the code.
(7) The provisions of the code shall not in any manner affect matters of record which refer to or are otherwise connected with ordinances which are therein specifically designated by number, and which are included within the code. Rather, such reference shall be construed to apply to the corresponding provisions contained in the code.
(8) The adoption of this code does not affect prosecutions for ordinance violations committed prior to the effective date of the ordinance adopting this code, does not waive any fee or penalty due and unpaid as of the effective date of the ordinance adopting this code, and does not effect the validity of any bond or cash deposit which was posted, filed or deposited pursuant to the requirements of any ordinance.
(9) If any section, subsection, sentence, clause or phrase of this code is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this code. [Ord. 410 §§ 1 – 9, 2009].
