8.20.010 Title.
This chapter shall be known as the "emergency code," and may be cited as such, and will be referred to in said sections as "emergency code." (Ord. 2852 (part), 2000)
8.20.020 Emergency defined.
A state of emergency exists whenever the city or any area therein is suffering, or is in imminent danger of suffering an event that may cause injury or death to persons, or damage to or the destruction of property to the extent that extraordinary measures must be taken to protect the public health, safety, and welfare; such an event shall include, but not be limited to the following:
A. A civil disorder, riot, or act of terrorism;
B. A natural disaster such as flood, windstorm, earthquake, fire, or epidemic;
C. Any major disruptions of community services such as transportation, power supply, water service, or communications; and
D. Special emergencies such as a hazardous material spill or release, or other emergency requiring resources outside the normal emergency response organization of the city. (Ord. 2852 (part), 2000)
8.20.030 Purpose.
The purpose of this emergency code is to provide a plan to minimize injury to persons and property, and to preserve the established civil authority in the event that a state of emergency exists within the city. (Ord. 2852 (part), 2000)
8.20.040 Executive responsibility.
The city manager is responsible for implementation of the emergency operations plan. When the city manager determines that a state of emergency exists, the city manager shall make a declaration to that effect and request the mayor to call a special meeting of the city council in order to ratify the declaration of emergency. 8.20.050 Declaration and ratification of emergency. The declaration by the city manager of a state of emergency shall:
A. State the nature of the emergency;
B. Designate the geographic boundaries of the area which is subject to the emergency controls; and
C. State any special regulations imposed as a result of the state of emergency.
D. In addition to the above, the ratification by the city council of a state of emergency shall:
1. State the duration of time during which the area so designated shall remain an emergency area; and
2. Authorize specific emergency power(s) for the duration of the emergency period set forth in the declaration. (Ord. 2852 (part), 2000)
8.20.060 Regulation and control of persons and property.
Whenever a state of emergency is declared to exist within the city of Cottage Grove, the city manager is empowered to order the following measures in the interest of public health, safety, or welfare, in the area designated as an emergency area:
A. Redirect city funds for emergency use and suspend standard city procurement procedures;
B. Establish a curfew for the area designated as an emergency area which fixes the hours during which all persons other than officially authorized personnel may not be upon the public streets or other public places;
C. Prohibit or limit the number of persons who may gather or congregate upon any public street, public place, or any outdoor place within the area designated as an emergency area;
D. Barricade streets and prohibit vehicular or pedestrian traffic, or regulate the same on any public street leading to the area designated as an emergency area for such distance as may be deemed necessary under the circumstances;
E. Evacuate persons from the area designated as an emergency area;
F. Throughout the city, or any part thereof:
1. Close taprooms and bars;
2. Prohibit the sale of alcoholic beverages;
3. Prohibit or restrict the sale of gasoline or any other flammable liquids;
4. Prohibit the sale, carrying, or possession of weapons or explosives of any kind on public streets, public places, or any outdoor place;
G. Order such other measures as are imminently necessary for the protection of life and/or property. (Ord. 2852 (part), 2000)
8.20.070 Penalties.
Any person who violates any emergency measure taken by the city manager under authority of this emergency code shall be subject, upon conviction, to a fine of not more than five hundred dollars or by imprisonment not exceeding six months, or both. However, no greater penalty shall be imposed than the penalty prescribed by the Oregon Statutes for the act, commission, or omission. (Ord. 2852 (part), 2000)
8.20.080 Duties.
It shall be the responsibility of the emergency program manager to recommend to the city manager a basic emergency operations plan to assist the city manager in the performance of the duties as directed by this emergency code. The city council shall be advised by the city manager of the basic emergency operations plan so formulated. In order to develop and maintain a basic emergency operations plan, the duties of the emergency program manager shall include, but not be limited to, the following:
A. Have the authority to cause those officials of city departments with emergency service capabilities to prepare coordinated, but individual, operational annexes to the basic emergency operations plan;
B. Assure that personnel, equipment, material, and supplies from city and private sources can be procured, when available, for use in the event of a state of emergency and provide for accounting of such items;
C. Provide for the coordination of the emergency plan, programs, and operations of federal, state, and county agencies, and other public and private agencies and corporations with emergency service capabilities;
D. Provide for, with the consent of the city council, coordinated operations under simulated state of emergency conditions. (Ord. 2852 (part), 2000)
