8.32.010 Delegation of authority.

The Crook County court authorizes the fire chief of the Crook County Rural Fire Protection District or his designated representative to extinguish any fire burning in any unprotected area of the county which upon consultation with local law enforcement officials in his judgment is causing or may cause undue jeopardy to life or property. (Ord. 182 § 1, 2006)

8.32.020 Authorization to impose conditions – Penalty.

The Crook County court further authorizes the Crook County Rural Fire Protection District fire chief or his designated representative to prescribe conditions and regulations for burning in unprotected areas in order to prevent catastrophic wildfire, to protect air quality and to prevent undue jeopardy to life or property as a result of fire. When such conditions are in effect, violation of any conditions shall be punishable as a violation of county ordinance. Any conditions or regulations which exceed one year’s duration shall be recorded with the office of the county clerk in the commissioners journal or other category of recording as the clerk may designate, and no such regulation shall be promulgated without 30 days’ advance notice to the public through publication in the newspaper of record of the county. The county court may by order at its sole discretion at any time void any such regulation. (Ord. 182 § 2, 2006)

8.32.030 Authorization to require permits for burning.

The court further authorizes the Crook County Rural Fire Protection District fire chief or his designated representative as conditions may warrant in order to prevent wildfire or to protect air quality to institute a permit system regulating burning on unprotected lands. Such permits, if required shall be issued without assessment of a fee or other cost to the applicant, and the fire chief shall cause a record of permits issued to be maintained. The fire chief or his designee is authorized to refuse, revoke or postpone issuance of permits as necessary to prevent danger to life or property, to prevent catastrophic wildfire and to protect air quality.
