18.88.005 Purpose.
The rural residential, R-5 zone is intended to provide for low-density rural home sites. The zone may be applied to areas committed to nonresource use or reserved for rural residential use as specifically provided for in the Crook County comprehensive plan. (Ord. 18 § 3.180, 2003)
18.88.010 Uses permitted outright.
In the R-5 zone, the following uses and their accessory buildings and uses are permitted subject to site plan review standards of this chapter:
(1) Single-family dwellings including manufactured dwellings in compliance with CCC 18.132.010.
(2) Buildings accessory to a single-family dwelling.
(3) Land partitioning or subdivision or planned unit for development for rural residential purposes.
(4) Residential homes.
(5) Farm use, subject to the limitations of this section.
(6) Transmission tower(s) less than 30 feet in height either from the existing grade or if located on an existing building from the base monopole shall be by site plan review, based on the standards contained within CCC 18.124.110. Lattice towers shall not be permitted to be constructed on existing buildings.
(7) Noncommercial wind energy systems and meteorological towers that meet the requirements of CCC 18.162.010.
(8) Noncommercial photovoltaic energy systems that meet the requirements of CCC 18.162.020.
(9) One accessory dwelling unit, used in conjunction with a legal single-family dwelling, for properties located within the urban growth boundary of the city of Prineville subject to the standards set forth in CCC 18.124.140.
(10) One accessory dwelling unit in the portion of the R-5 zone west of Hwy 27 and south of Hwy 370, subject to the standards set forth in CCC 18.124.140(2). (Ord. 344 § 5 (Exh. 18.88.020 Conditional uses permitted.
In an R-5 zone, the following uses and their accessory uses may be permitted subject to Chapter 18.160 CCC:
(1) Home occupations.
(2) Public parks, playgrounds, or recreation facility, or community center.
(3) Kennels.
(4) Transmission tower(s) greater than 30 feet in height and shall meet the standards contained within CCC 18.124.110. Colocation facilities shall meet the standards contained within CCC 18.124.110 and 18.160.050(17) as required.
(5) Expansion of existing DEQ approved sewage treatment facilities including necessary and accessory structures, holding ponds, pipes and equipment.
(6) New sewage treatment facility when required by DEQ.
(7) Destination resorts may be allowed as a conditional use, subject to all applicable standards of the DRO zone, Chapter 18.116 CCC.
(8) Noncommercial wind energy systems and meteorological towers that do not meet the requirements of CCC 18.162.010 are subject to any additional standards of the zone and Chapter 18.160 CCC.
(9) Noncommercial photovoltaic energy systems that do not meet the requirements of CCC 18.162.020 are subject to any additional standards of the zone and Chapter 18.160 CCC.
(10) Commercial power generating facilities subject to the standards of Chapters 18.160 and 18.161 CCC. (Ord. 245 § 1, 2011; Ord. 229 § 1 (Exh. A), 2010; Ord. 18 § 3.180(2), 2003)
18.88.030 Lot size.
The minimum property size for a new parcel shall be five acres in size. (Ord. 18 § 3.180(3), 2003)
18.88.040 Yard and setback requirements.
In an R-5 zone, the following yards and setbacks shall be maintained:
(1) Front yard setback from the property line shall be a minimum of 100 feet if said front property line is adjacent to an intensive agriculture use; otherwise, front yards shall be 20 feet for property fronting on a local minor collector or marginal access street ROW, 30 feet from a property line fronting on a major collector ROW, and 80 feet from an arterial ROW unless other provisions for combining accesses are provided [and approved] by the county.
(2) Each side yard shall be a minimum of 20 feet, except that on corner lots or parcels, the side yard on the street side shall be a minimum of 30 feet, and for parcels or lots with side yards adjacent to an intensive agricultural use, the adjacent side yard shall be a minimum of 100 feet.
(3) Rear yards shall be a minimum of 25 feet, except for parcels or lots with rear yards adjacent to an intensive agricultural use said rear yards shall be a minimum of 100 feet.
(4) In the Ochoco West Subdivision, the front yard setback shall be 25 feet, the side yard setback shall be 10 feet, and the rear yard setback shall be 10 feet. The setback for any side or rear yard adjacent to a street shall be no less than 10 feet. (Ord. 18 § 3.180(4), 2003)
18.88.050 Dimensional standards.
In an R-5 zone, the following dimensional standards shall apply:
(1) Percent of Lot Coverage. The main building and accessory buildings located on any building site or lot shall not cover in excess of 30 percent of the total lot area.
(2) Building Height. No building or structure, nor the enlargement of any building or structure, shall be hereafter erected to exceed two stories or more than 30 feet in height. (Ord. 18 § 3.180(5), 2003)
18.88.060 Limitations on livestock.
The following limitations on livestock shall apply in an R-5 zone:
(1) Cows, horses, goats or sheep cannot be kept on lots having an area of less than 20,000 square feet. The total number of all such animals (other than their young under the age of six months) allowed on a lot shall be limited to the square footage of the lot divided by the minimum area required for each animal as listed below:
Horses – 20,000 square feet of area for each adult animal.
Cows – 20,000 square feet of area for each adult animal.
Goats – 20,000 square feet of area for each adult animal.
Sheep – 20,000 square feet of area for each adult animal.
(2) The number of chickens, fowl and/or rabbits (over the age of six months) shall not exceed one for each 500 square feet of property. The number of young under the age of six months allowed on the property at any time shall not exceed three
times the allowable number of adult animals. (Ord. 18 § 3.180(6), 2003)

18.88.090 Wildlife policy applicability.
The residential density limitations and the lot and parcel size limitations found in Wildlife Policy 2 of the Crook County comprehensive plan do not apply to any nonresource zones. (Ord. 236 § 1 (Exh. A), 2010)
