8.04.010 Permits required.

From and after the passing of the ordinance codified in this chapter, it shall be unlawful for any person to burn weeds, trash, refuse or any other materials of any kind on any lands in the city of Culver without obtaining a written permit to do so from the fire chief or his designated agent of the city of Culver. All permitted fires shall comply with this chapter. [Ord. 276 § 1, 1985.]

8.04.020 Permits – Issuance.

Permits shall be issued by the fire chief or his designated agent. The incinerator or burning site shall comply with the burning regulations set forth in this chapter. [Ord. 276 § 2, 1985.]

8.04.030 Incinerators – Residential.

Residential incinerators shall be constructed so that fires are contained completely within a combustion chamber of an approved type. [Ord. 276 § 3, 1985.]

8.04.040 Incinerators – Commercial, industrial and apartment-type.

Commercial, industrial and apartment-type incinerators shall be constructed so that fires are contained completely within a combustion chamber of an approved type. [Ord. 276 § 4, 1985.]

8.04.050 Approved type of incinerators and their location.

Residential, commercial, industrial and apartment-type incinerators shall be constructed of brick, concrete or steel barrel (no smaller than a 55-gallon drum), in good condition with a spark arrester constructed of iron, heavy wire mesh or other noncombustible material, with openings not larger than one-half inch. Incinerators shall be of a sufficient size or quantity to confine all material within combustion chambers with a spark arrester at all times when burning. Incinerators shall be no closer than 10 feet to structures and combustibles and 15 feet from overhanging branches and trees. [Ord. 276 § 5, 1985.]

8.04.060 Open burning and location.

No person shall burn weeds, trash, refuse or any other material without first obtaining written permit from the fire chief of the city of Culver or his designated agent. The location site shall be free from weeds, trees and shrubs, at least 15 feet from the pile to be burned, and 25 feet from any structure. [Ord. 276 § 6, 1985.]

8.04.070 Prohibited burning.

A. The fire chief of the city of Culver shall determine when conditions of extreme hazard exist and shall allow no burning until such a time that conditions no longer exist; the fire chief shall make a proclamation of such conditions and publish the notice thereof in general posting within the city of Culver and shall refuse to issue validation of any permit or permits.

B. There shall be no burning after the hour of 3:00 p.m.; all fires and smokes shall be out by 4:00 p.m., except those hours of summer burning from the first day of June to the first day of October; the hours are from 6:00 a.m. to 11:59 a.m.; all fires and smokes must be out by 2:00 p.m. There shall be no burning on Sundays and/or legal holidays recognized by the state of Oregon.

C. It is unlawful for any person to burn any obnoxious material and cause a stench or offensive odor. It is further unlawful for any person pursuant to this order to burn garbage, animal matter, tires, rubberized material, plastics, oil or chemical waste. By enumerating these materials the city of Culver does not imply to restrict burning of any other obnoxious or offensive materials. This section shall apply for the entire year and shall not be limited by the burning dates and times otherwise specified. [Ord. 276A § 1, 1993; Ord. 276 § 7, 1985.]

8.04.080 Violation – Penalty.

Any persons or person who shall violate the provisions of this chapter shall be deemed guilty of a Class B infraction and upon conviction thereof in the municipal court shall pay a fine of not less than $5.00 nor more than $100.00. [Ord. 276 § 9, 1985.]
