OFFENSES BY OR AGAINST MINORS

9.20.010 Curfew hours for minors.

A. No minor under the age of 18 years shall enter upon any street, highway, park, alley or other public place in the city of Culver between the hours of 10:00 p.m. and 5:00 a.m. of the following morning unless said minor is accompanied by a parent, guardian or other person 21 years of age or older and authorized by the parent or other person 21 years of age, or unless said minor is then and there engaged in a lawful pursuit or activity which requires his presence in such public place during the hours specified in this section.

B. Violation of subsection A of this section shall constitute a Class A infraction. In addition and not limited to any fine imposed by action of the city court there shall also be due to the city of Culver by the parents, legal guardian or custodian of the child such sum as to reimburse the city of Culver for any property that was destroyed or vandalized by acts of the children. The court may impose as a fine the amount necessary to make repairs or recovery for destroyed property and the limits of said fine may be the value of the damage and may exceed the fine that is imposable as a Class A infraction. 9.20.020 Purchase or possession of liquor by person under 21 years of age.

A. No person under the age of 21 years shall attempt to purchase or acquire alcoholic liquor. Except when such minor is in a private residence accompanied by his parent or guardian and with such parent’s or guardian’s consent, no person under the age of 21 years shall have in his possession alcoholic liquor.

B. For the purposes of this section, possession of alcoholic liquor includes the acceptance or consumption of a bottle of such liquor, or any portion thereof, or a drink of such liquor. However, this section does not prohibit the acceptance or consumption by any person of sacramental wine as part of a religious rite or service. [Ord. 355 § 13, 1985.]

9.20.030 Confining or locking children in vehicles prohibited.

A. From and after the effective date of the ordinance codified in this section, it shall be unlawful for any person, parent, guardian, committee or other persons in charge of or who have under their control or guidance any minor child under the age of 10 years to at any time lock or confine or suffer to be locked or confined or leave unattended such children in any automobile, coach, bus or other vehicle or in any place upon the streets, alleys or ways of or within the city of Culver, Oregon, for a period of longer than 30 minutes.

B. It shall be lawful and the duty of any policeman or any police officer of the city of Culver, Oregon, finding a child or children confined or abandoned in violation of the terms of this section, to enter such automobile, coach, bus or other vehicle or places upon the streets, alleys or ways of the city of Culver, Oregon, and remove such child, such officer having the right to break the doors and windows of such vehicle in order to save the life of such child or to save the child from great mental or physical suffering. 9.20.040 Violation – Penalty.

Any person violating any of the provisions of this chapter shall, upon conviction thereof, be punished as a Class A infraction by a fine of not more than $500.00. [Ord. 355 § 26, 1985.]
