2.16.010 Establishment.

There is hereby reestablished a city planning commission for the city of Dundee, Oregon. [Ord. 162 § 1, 1974].

2.16.020 Membership.

A. The commission shall consist of seven members who are not officials or employees of the city. Commission members shall receive no compensation, but may be reimbursed for expenses duly authorized by the city council.

B. Members shall have their principal place of residency inside the city limits and shall have resided continually in the city one year prior to their appointment to the commission, except one member may be a nonresident provided he/she owns real property in the city and has owned real property continually in the city one year prior to his/her appointment.

C. No more than two of said members shall be engaged principally in the buying, selling or developing of real estate for profit as individuals, or be members of any partnership, or officers or employees of any corporation that is engaged principally in buying, selling or developing of real estate for profit. No more than two of said members shall be engaged in the same kind of occupation, business, trade or profession. [Ord. 501-2011 § 1; Ord. 259 § 1, 1985; Ord. 162 § 2, 1974].

2.16.030 Appointment and term.

Members of the planning commission shall be appointed by the city council for a term of four years except for appointments made for other specified terms in order to establish an approximately equal expiration of terms every two years. [Ord. 429-2005 § 1; Ord. 162 § 3, 1974].

2.16.040 Vacancies and removal.

Appointments to fill vacancies shall be for the remainder of the unexpired term. A member may be removed by the city council, after hearing, for misconduct or nonperformance of duty. A member who is absent from three consecutive meetings without an excuse as approved by the planning commission is rebuttably presumed to be in nonperformance of duty, and the city council shall declare the position vacant unless finding otherwise following the hearing. 2.16.050 Officers.

At its first meeting of each even-numbered calendar year, the commission shall elect a chairperson and vice-chairperson to serve two-year terms. If a vacancy occurs during a two-year term of office of either the chairperson or vice-chairperson, an election shall be held at the next meeting to fill the vacant officer position for the remainder of the unexpired term. 2.16.060 Meetings.

A majority of the members of the planning commission shall constitute a quorum. The commission shall meet at least once a month. Meetings of the commission shall be open to the public. Meetings other than at regularly scheduled times may be announced at a prior meeting, and thereby be made a part of the meeting records. The chairman upon his motion may or, at the request of three members of the commission, shall, by giving notice to members of the commission, call a previously unannounced special meeting of the commission for a time not earlier than 24 hours after notice is given. Notice of a previously unannounced meeting, other than to commission members, shall be given as provided by law. [Ord. 162 § 6, 1974].

2.16.070 Powers and duties.

The commission shall have the powers and duties which are now or may hereafter be assigned to it by charter, ordinances or resolutions of the city and general laws of this state. The commission shall administer the subdivision and zoning ordinance of the city and may make recommendations to the city council, to public officials and to individuals regarding land use, location of thoroughfares, public buildings, parks and other public facilities, and regarding any other matter relating to the planning and development of the city and the surrounding areas. The commission may make studies, hold hearings and prepare reports and recommendations on its own initiative or at the request of the city council. The commission shall, on October 1st of each year, make and file a report of all its transactions with the city council. All recommendations and suggestions and reports made to the city council by the commission shall be in writing. [Ord. 162 § 7, 1974].

2.16.080 Expenditures.

The commission shall have no authority to make expenditures on behalf of the city or to obligate the city for payment of any sums of money except as herein provided, and then only after the city council shall have first authorized such expenditure by appropriate action. [Ord. 162 § 8, 1974].

2.16.090 Conflict of interest.

A member of a planning commission shall not participate in any commission proceedings or action in which any of the following has a direct or substantial financial interest: the member or his spouse, brother, sister, child, parent, mother-in-law, father-in-law, any business which he is then serving or has served within the previous two years, or any business with which he is negotiating for, or has an arrangement or has an understanding concerning prospective partnership or employment. Any actual or potential interest shall be disclosed at the meeting of the commission where the action is taken. [Ord. 162 § 9, 1974].

2.16.100 Hearings.

Until the city council designates a hearings officer for planning and zoning matters, the planning commission shall perform such function; all such hearings shall be pursuant to procedures adopted by the city council for the conduct of hearings. [Ord. 162 § 10, 1974].
