15.40.010 Temporary structures.
A. Approval. A temporary structure may not be constructed or placed upon real property without prior approval by the city. The approval may limit the duration of time during which the structure may be sited, used, or occupied. The approval will be site-specific and a temporary structure may not be relocated to any other site without a new approval having been obtained.
B. Requirements based on description of structure or use and time limitations:
1. Temporary structures accessory to one- and two-family dwellings:
a. Temporary structures and temporary uses shall require permits, and shall comply with the requirements of, the provisions of the Oregon Residential Specialty Code. Such permits shall be limited as to time of service but shall not be permitted for more than 180 days.
2. Temporary structures other than those accessory to one- and two-family dwellings:
a. Temporary tents, umbrellas and other membrane structures erected less than 180 days are regulated by the fire official.
b. Other temporary structures erected for less than 180 days must comply with the requirements of the building code and require permits and inspections from the Building Department.
c. Membrane structures (air-supported, air-inflated, membrane-covered cable, membrane-covered frame and tensile membrane structures erected for a period of 180 days or more shall comply with Sections 3102.1 through 3102.8 of the Oregon Structural Specialty Code. (See Oregon Structural Specialty Code definitions for “tent” and “membrane structure”).
d. Other temporary structures erected for more than 180 days shall comply with all applicable sections of the Oregon Structural Specialty Code.
C. Connections. No temporary structures shall be permanently connected to any utilities and all utility connections should be disconnected and removed immediately upon removal of the temporary structure or expiration of the placement approval. The building official may require water and sanitation facilities when necessary for public health considerations.
D. Temporary Power. Temporary power shall require a permit and shall conform with the requirements of the Oregon Electrical Specialty Code.
E. The building official is authorized to grant extensions, when requested in writing from the owner, for demonstrated cause.
F. The building official is authorized to terminate such permit for a temporary structure or use and to order the temporary structure or use to be discontinued. [Ord. 2022-03 § 1 (Exh. A)].
15.40.020 Portable structures.
A. Approval. A portable structure may not be constructed or placed upon real property without prior approval by the city. The approval may limit the duration of time during which the structure may be sited, used, or occupied. The approval will be site-specific and a portable structure may not be relocated to any other site without a new approval having been obtained.
B. Connections. No portable structures shall be permanently connected to any utilities and all utility connections should be disconnected and removed immediately upon removal of the portable structure or expiration of the placement approval. The building official may require water and sanitation facilities when necessary for public health considerations.
C. Placement. Structures such as cargo containers and other preconstructed structures shall not be placed in parking lots or areas not specifically approved for such use and shall not be used in place of permanent structures. [Ord. 2022-03 § 1 (Exh. A)].
