8.40.010 Definitions.
As used in this chapter, unless the context requires otherwise, “consumer fireworks” means as defined in state law. (Ord. 4-2022 § 1 (Exh. A))
8.40.020 Conditions warranting prohibition on consumer fireworks.
A. In the event the Multnomah Fire Defense Board issues an outdoor burn ban that covers all or part of the city of Fairview, the city manager shall issue an order prohibiting the use of consumer fireworks in the city and take all steps to effectuate the order including publicizing the burn ban and fireworks order in a manner that notifies the public of the ban.
B. The city council may rescind and invalidate an order issued under this section if the council finds the conditions in the city do not warrant such a ban. (Ord. 4-2022 § 1 (Exh. A))
8.40.030 Penalty.
In addition to other penalties provided by law, a violation of the city manager’s order prohibiting consumer fireworks shall constitute a violation of the Fairview Municipal Code under FMC 1.01.090. (Ord. 4-2022 § 1 (Exh. A))
