POSSESSION AND DELIVERY OF DRUGS

9.40.010 General provisions.
(1) Schedules. The scheduling or classifications of controlled substances promulgated by the Oregon State Board of Pharmacy as of November 30, 1983, are adopted and incorporated in this chapter by this reference.
(2) Oregon Revised Statute Chapter 475, as constituted on November 30, 1983, is adopted and incorporated in this chapter by this reference.

9.40.020 Prohibited acts generally.
(1) Except as authorized by ORS 475.000 through 475.285 and 475.940 through 475.995, it is unlawful for any person to manufacture or deliver a controlled substance. Any person who violates this section with respect to:
(a) A controlled substance in Schedule IV is guilty of a Class “B” misdemeanor.
(b) A controlled substance in Schedule V is guilty of a Class “C” misdemeanor.
(2) Any person who knowingly or intentionally possesses, or delivers for no consideration, less than one avoirdupois ounce of the dried leaves, stems and/or flowers of the plant Cannabis, family Moraceae is guilty of a violation punishable by a fine not less than five hundred dollars ($500) and not more than one thousand dollars ($1000).

9.40.030 Prohibited acts involving records and fraud.
(1) It is unlawful for any person, knowingly or intentionally, to acquire or obtain possession of a controlled substance as misrepresentation, fraud, forgery, deception or subterfuge.
(2) A violation of this section shall be a Class “A” misdemeanor.

9.40.040 Penalties for distribution to minors.
(1) Except as authorized by ORS 475.005 through 475.285 and 475.991 through 475.995, it is unlawful for any person to deliver a controlled substance to a person under eighteen years of age. Any person who violates this section with respect to:
(a) A controlled substance in Schedule IV is guilty of a Class “A” misdemeanor.
(b) A controlled substance in Schedule V is guilty of a Class “B” misdemeanor.
