9.15.010 Title.

This chapter shall be known as the “Fence Regulation Ordinance” of the city of Halsey, Linn County, Oregon. [Ord. 248 § 1.010, 1980.]

9.15.020 Purpose.

The purpose of this chapter is to set forth the regulations of fences constructed within the residential and commercial zones of the city of Halsey. [Ord. 248 § 1.020, 1980.]

9.15.030 Definitions.

As used in this chapter the following words and phrases shall mean:

“City” means the city of Halsey, Oregon.

“Fence” means a continuous fence, wall, evergreen planting or combination thereof, constructed and/or planted so as to effectively screen the particular use from view.

“Vision clearance area” means a triangular area formed by the three points listed below, in which no landscaping, wall or display shall interfere with the unobstructed view over a height of three feet above the nearest street. The three points are as follows:

(a) The intersection of the property lines at the corner.

(b) Two points located 20 feet back from this intersection, on each property line, or at intersections including an alley 10 feet back. [Ord. 248 § 1.030, 1980.]

9.15.040 Requirements.

The construction and/or planting of a fence must meet these requirements:

(1) Fences, which may be located within yards, shall not exceed six feet in height, measured from the top of the curb or, where no curb exists, from the established street center line grade and shall not conflict with requirements of a vision clearance area.

(2) No person shall construct or maintain any barbed wire to remain as part of any fence, unless such wire is placed not less than six inches above the top of a nonbarbed wire fence which is not less than five feet in height.

(3) No person shall install, maintain or operate a wire fence charged with electrical current within the city.

(4) Every person in possession of land on which there is situated an excavated or portable swimming pool, fish pond or other artificial body of water which contains water 18 inches or more in depth at any point shall erect and maintain on the lot or premises upon which such pool or body of water is located an adequate fence or wall sufficient to make such pool or body of water inaccessible to small children. Such fence or wall must completely surround such pool or body of water and the fence shall not be less than four feet above the underlying ground; provided, however, that a dwelling or accessory building may be used as part of such enclosure. 9.15.050 Enforcement.

It shall be the duty of any local peace officer to serve written notice upon any person or persons, company or corporation found in violation of this chapter and to file a complaint for violation of this chapter before the municipal court of the city. [Ord. 248 § 1.050, 1980.]

9.15.060 Penalty.

A person violating a provision of this chapter shall, upon conviction, be punished by a fine of not more than $500.00. A violation of this chapter shall be considered a separate offense for each day the violation continues. [Ord. 276, 1985; Ord. 248 § 1.060, 1980.]
