The Hubbard farmer’s market commission is hereby established as a permanent commission of the city of Hubbard. (Ord. 364-2020 § 1 (Exh. A); Ord. 362-2019 § 1 (Exh. A))
2.60.020 Membership and qualifications.
(1) The commission shall be composed of seven or nine voting members appointed by the city council.
(2) The public works director or the director’s designee shall serve as a nonvoting ex officio staff liaison member of the commission and provide staff support to the commission.
(3) Commission members shall receive no compensation for participation in commission activities.
(4) Unless otherwise exempted by the council for good cause, to be eligible for appointment and to continue serving as a commission member, an individual must commit to and actually serve as the market manager for at least two market days. As market manager, the individual will be present and lead the market on the day on which they serve as market manager, answer questions as they arise, and be available to generally oversee market operations. 2.60.030 Term of office.
(1) Each commission member shall be appointed to serve a term of three years beginning October 1st and ending September 30th of the third year following appointment. Members may be reappointed to additional terms at the council’s discretion.
(2) The initial terms of commission members will be staggered so that four members shall be appointed for three-year terms and three or five members shall be appointed to one-year terms. Thereafter, as each commissioner’s term expires, that commissioner’s position shall be filled by the council by appointment to a three-year term at the first regular meeting of September of the year in which that commissioner’s term expires.
(3) Vacancies shall be filled by appointment of the council for the remainder of the unexpired term.
(4) Members serve at the pleasure of the council and may be removed by the council at will. Upon removal, the council shall as expeditiously as reasonably possible appoint a new commission member to fill the unexpired term of the removed member.

2.60.040 Organization of commission.
(1) Officers. The commission shall elect a chairperson and vice-chairperson from its members at its first meeting in October of each year. In the event of vacancy or removal in the chairperson’s or vice-chairperson’s position, the commission shall fill the same by election at its next regular meeting.
(2) Staff. The city council shall provide a secretary to the commission and such other staff and consultation services as may be reasonable and necessary. The secretary shall keep a record of commission proceedings.
(3) Meetings. A majority of the members of the commission appointed and serving shall constitute a quorum. Regular meetings shall be scheduled not less than once per month at a time determined by the commission. Special meetings may be called by the chairperson or at the request of three members of the commission upon not less than 24 hours’ notice posted at the City Hall, personally delivered to the residential address of each commission member and otherwise given in a manner reasonably calculated to provide actual notice to interested persons and otherwise in compliance with Oregon’s open meetings law.
(4) The commission may make, establish and alter rules and regulations for its proceedings consistent with the laws of the state of Oregon and with the Charter and ordinances of the city of Hubbard. (Ord. 364-2020 § 1 (Exh. A); Ord. 362-2019 § 1 (Exh. A))
2.60.050 General powers and duties of the commission.
The commission shall:
(1) Implement a seasonal farmer’s market within the city of Hubbard between June and September of each year;
(2) Implement any necessary rental agreement between the city and a property owner, if the market is not conducted on city property, for the use of such property for the farmer’s market;
(3) Draft and revise city policies and agreements for participation in the market, to be approved by the city attorney’s office;
(4) Enter into agreements with participants of the farmer’s market;
(5) Promote public interest in, and understanding of, the farmer’s market;
(6) At the commission’s option, the commission may develop a volunteer program to grow produce on city property and to sell the produce at the farmer’s market. Such a program must be approved by the council via resolution;
(7) Present an annual report to the council no later than December 31st of each year regarding the work of the commission, the effect of the farmer’s market on the community and any other relevant information or recommendations related to the commission’s work;
(8) Recommend to the council new ordinances or amendments to the existing municipal code which would assist with the implementation and success of an annual seasonal farmer’s market within the city; and
(9) Work with city staff to perform any and all other necessary steps to implement the city’s farmer’s market. (Ord. 364-2020 § 1 (Exh. A); Ord. 362-2019 § 1 (Exh. A))
