COUNTY SURFACE MINING OPERATIONS

2.12.040 Designation of surface mining administrator.
2.12.010 Purpose.
The purpose of this chapter is to govern surface mining operations by Jefferson County itself, in view of the fact that Jefferson County sells less than five thousand (5,000) cubic yards of minerals within any consecutive twelve (12) month period. The effect of this chapter will be to exempt Jefferson County from the state mining permit requirements set forth in ORS 517.702 to 517.987. (Ord. O-43-98 § 1, 1998)
2.12.020 Reclamation scheme.
All surface mining operations performed by Jefferson County pursuant to this chapter shall remain under the exclusive control of Jefferson County until reclamation is complete and shall be subject to the following reclamation scheme:
A. At the commencement of each surface mining operation, Jefferson County shall cause to be filed in its records, a reclamation plan, which is consistent with OAR 632-030-0025(1)(a) through (e).
B. The reclamation plan shall also contain provisions to maintain the pre-mine quality of affected water resources, pursuant to OAR 632-030-0025(1)(j).
C. The reclamation plan shall also contain provisions for the protection of public health arid safety, pursuant to OAR 632-030-0025(1)(o).
D. The reclamation plan shall contain a time schedule for surface mining and reclamation pursuant to OAR 632-030-0025(1)(t).
E. Reclamation sloping shall be performed pursuant to OAR 632-030-0025(1)(u).
F. Any other pertinent and relevant requirements set forth in OAR 632-030-0025 shall be performed in the Jefferson County reclamation plan. (Amended during 2001 codification; Ord. O-43-98 § 2, 1998)
2.12.030 Reporting.
Each year the county shall provide the Department of Geology and Mineral Industries with a list of sites operating under the exemption and the name of the designated Jefferson County surface mining administrator. (Ord. O-43-98 § 3, 1998)
2.12.040 Designation of surface mining administrator.
The Jefferson County director of public works is designated as the Jefferson County surface mining administrator. (Ord. O-43-98 § 4, 1998)
