RECREATION AREAS

12.12.010 Purpose.
A. Recreation area rules have been established to provide a safe and enjoyable recreational environment, and to protect the natural resources. Persons who do not respect the rights of other visitors by conducting themselves outside the established recreation area rules may be asked to leave and/or will be subject to citation.
B. “Recreation areas” are defined for the purpose of this chapter as Haystack Reservoir, Perry South Campground, Monty Campground, Street Creek Day Use Area, Pelton Park, Chinook Island, BLM Beach Areas and United States Forest Service Campgrounds. 12.12.020 Rules.
A. Firearms and Fireworks. No person shall, except during recognized game seasons authorized by the land managing agency:
1. Discharge any firecrackers, rockets or any other type of fireworks or explosive devices upon these premises;
2. Discharge any firearm, pellet or BB gun, bow and arrow, sling shot or any other weapon capable of injuring any person, bird or animal.
B. Litter. No person shall dispose of any garbage or waste in any place other than provided receptacles. If no receptacle is provided, persons are required to take with them any garbage or waste they have brought to these areas.
C. Operating Vehicles. No person shall operate any motorized vehicle upon the premises of these areas except upon designated roads unless said operation is directly in conjunction with authorized ranching or maintenance activities. All motorized vehicles must be parked in authorized parking areas and in such a manner that they do not in any way impede traffic upon designated roads. Except as specifically authorized in this chapter, motorized vehicles shall not be used for any other purpose other than to enter or exit the premises of these areas.
D. Campfires. Burning of any living, dead or down vegetation from within the recreation area is prohibited. No person shall start or build an unsafe uncontained or uncontrolled fire in any area on these premises. Types of safe fire containment areas include but are not limited to fire pits and fireplaces. No person after starting or building a fire shall leave it unattended. All fires shall be extinguished before the user leaves these areas. All persons shall comply with all federal, state and county fire closures and regulations. No fires are allowed at Chinook Island.
E. Camping.
1. Camping shall be allowed only in designated areas. No person shall camp for any longer than fourteen (14) days within any thirty (30) day period in the recreation areas. Overnight camping is prohibited on Chinook Island.
2. Any group occupying fee or designated non-fee sites shall be required to contain all group and personal equipment within the site. Where a site boundary is marked, all group and personal equipment shall be contained within those boundaries. Where no site boundary is provided, all group and personal equipment shall be contained within a line one-half the distance between site designation markers. As far as is practical, all camping equipment such as tents and/or tables shall be erected or used within the most impacted core area of the site.
3. All designated non-fee boat-in campsites within the BLM Beach Area shall be occupied on a first come-first serve basis. Campsites may not be reserved or held for later occupation. One person may occupy and thereby hold only one campsite. Placing group or personal property in a campsite not occupied by at least one person, for the purpose of holding or reserving the site for later occupation is prohibited.
F. Destruction of Property. Unless specifically authorized by the land managing agency, no person shall pick, cut, mutilate or remove any flowers, shrubs, foliage, plant life or products of any kind from these areas. No person shall disturb or remove any archeological or natural resource from these areas. No person shall mutilate, damage, deface or remove any table, bench, building, sign, marker, monument, fence, structure or facility located within these areas.
G. Public Behavior. All visitors to these areas shall observe quiet hours from 10:00 p.m. to 7:00 a.m. All visitors shall at all times maintain a reasonable noise level so that all persons enjoying the recreation area may enjoy their stay. During quiet time, noise at a level that can be heard in neighboring campsites and which could interfere with those trying to sleep is considered excessive.
H. Pets and Animals.
1. No person shall bring any dog, cat or any other kind of animal to these areas unless the animal is on a leash under six feet long and under the physical control of the owner at all times. All persons bringing pets or other animals shall be responsible for the removal and disposal of their animal’s waste. The release or abandonment of domestic animals is prohibited. This prohibition shall not apply to any movement of livestock where such movement has been authorized by the land managing agency.
2. Except recognized game hunting authorized by the land managing agency, no person shall hunt, pursue, trap, kill, injure or molest any birds or animals or disturb their habitat upon the premises of the reservoir area.
I. Business Activities. No person shall sell or offer to sell any merchandise of any kind upon the premises of these areas unless permitted to do so by the land managing agency.
J. Signs and Posters. No person shall post, place or erect any sign, poster or notice without obtaining a permit and/or written permission from the land managing agency.
K. Water Safety. All water activities are subject to Coast Guard regulations. All persons swim, dive, and snorkel at their own risk. Swimming in boat launch areas is strictly prohibited.
L. Eviction and Exclusion. A peace officer, as defined in ORS 161.015, pursuant to a written agreement with the land managing agency of these lands, may seek compliance from the public with any recreation area rule and may order a person who violates any rules to leave the area immediately.
M. Day Use Permits. A valid day use permit issued by the land managing agency is required to be displayed on all motor vehicles at Haystack Reservoir.
N. Portable Toilets.
1. An approved portable toilet shall be carried and used by overnight boating groups that remain, intend to remain, or display intent to remain overnight within the BLM Beach Area, except that this requirement shall not apply to overnight kayak trips that are entirely self-contained and not supported by other craft carrying gear or boats moored to the bank that have an approved marine grade toilet facility on board. While present within the BLM Beach Area on an overnight boating basis, all persons shall, whenever practical, use an approved portable toilet for all solid human waste.
2. All persons who remain, intend to remain, or display intent to remain overnight in an undeveloped camp site shall set up an approved portable toilet, ready for use, as soon as practical upon landing at the camping site to be occupied. No person shall leave, deposit, or scatter human waste, toilet paper, or items used as toilet paper, on the ground within the BLM Beach Area. While within the BLM Beach Area, portable toilets shall only be dumped at facilities developed and identified especially for that purpose. When the situation makes it impractical to use a portable toilet, persons shall bury all human waste and toilet paper, or material used as toilet paper, at least six inches below the surface of the ground in natural soil and at least fifty (50) feet from the edge of the water or any other water source.
3. Definitions.
a. “Approved portable toilet” is any non-biodegradable, rigid, durable container designed to receive and hold human waste, in any container position, without leaking, and equipped with a dumping system that allows the container to be emptied and rinsed into a standard receiving or dump system designed for that purpose, such as a SCAT machine or recreational vehicle dump station, in a sanitary manner, without spills, seepage or human exposure to human waste.
b. “Remain overnight” means human presence in the BLM Beach Area on a boat-in basis for any period of time from one hour after legal sunset to one hour before legal sunrise.
c. “Display intent to remain overnight” while within the BLM Beach Area on a boat-in basis includes, but is not limited to, any off-loading onto the water bank, or preparing for use, common overnight camping equipment such as tents, sleeping bags or bedding, food, cooking or dining equipment, or lighting equipment, or to prepare common camping equipment for use in or on any boat.
O. Penalties.
1. Violation of this chapter shall be punishable by a fine of at least fifty dollars ($50.00), but not more than two hundred dollars ($200.00).
2. Each occurrence of a violation of a recreation area rule shall be considered a separate violation.
3. Funds. All funds from penalties paid through the enforcement of this chapter shall be paid into the county general fund.
4. If there is a violation of any provision identical to a state statute with a lesser penalty attaching, punishment shall be limited to the lesser penalty prescribed in state law.
P. Severability. Should any portion of the ordinance codified in this chapter be adjudged by a court of competent jurisdiction to be unconstitutional or invalid, such judgment shall not affect, impair, invalidate or nullify the remaining provisions. It is the intent of the Jefferson County board of commissioners to enact the remainder of the ordinance codified in this chapter notwithstanding any part which may be declared unconstitutional or invalid.
