Petitions, applications and appeals provided for in this title shall be made on forms prescribed by the county. (Ord. O-160-2000 Exh. A § 13.1, 2000)
16.60.015 Final subdivision and partition plat approval and signature.
Pursuant to ORS 92.100(1)(e), the board hereby authorizes the chairperson of the board to approve and sign all final subdivision and partition plats on behalf of the board. If the chair is unavailable to approve and sign, then this function is delegated to any other commissioner on the board. (Ord. O-108-05 § 1, 2005)
16.60.020 Hearings.
Hearings, appeals and review shall comply with the provisions of Jefferson County’s land use procedures. (Ord. O-160-2000 Exh. A § 13.2, 2000)
16.60.030 Review by board of commissioners and planning commission.
The board of commissioners or planning commission may review a lower decision upon its own motion after giving ten (10) days notice to the parties involved in the decision, and if such review is initiated within fifteen (15) days of receipt of notice of said lower decision. 16.60.040 Exceptions.
Land partitions, Type I or Type II subdivisions may be reviewed and approved or denied if:
A. A properly completed land partition, Type I or Type II subdivision application is filed with the planning department.
B. Notice is sent by the planning department to all property owners within two hundred fifty (250) feet inside the UGB and five hundred (500) feet outside the UGB.
C. The partition, Type I or Type II subdivision complies with all applicable provisions of the county subdivision and zoning ordinances.
D. Decision. In the notice sent under subsections A and B of this section, shall indicate that the decision shall be final unless appealed within fifteen (15) days following the date of mailing of the decision.
E. Appeals. A decision under this section shall be final unless a notice of appeal is received in accordance with the county’s adopted land use procedures. (Ord. O-160-2000 Exh. A § 13.4, 2000)
16.60.050 Penalties.
Violation of any provision of this title is a violation, and shall be enforced through the Jefferson County Circuit Court. Penalties shall be in accordance with ORS 92.990. (Ord. O-160-2000 Exh. A § 14.1, 2000)
16.60.060 Violation declared a nuisance.
A land division or use in violation of this title is declared a nuisance. (Ord. O-160-2000 Exh. A § 14.2, 2000)
16.60.070 Compliance with Oregon real estate regulations.
Prior to the sale of any lot within a subdivision, a final subdivision plat shall be approved and recorded, and the subdivider shall file notice of intent with the Oregon State Real Estate Division. (Ord. O-160-2000 Exh. A § 14.3, 2000)
16.60.080 Civil relief.
When any real property is used or is proposed to be used, transferred, sold or disposed of in violation of this title, the planning director or any person whose interest in the property is or may be affected by the violation, may in addition to other remedies provided by law, institute injunction, mandamus, abatement or other appropriate proceedings to prevent, temporarily or permanently enjoin, abate or set aside such use, transfer, sale, disposition, offer, negotiation or agreement. 16.60.090 Administration of title.
It shall be the duty of the planning director or designated representatives to administer and enforce the provisions of this title in such way as to carry out its intent and purpose. (Ord. O-160-2000 Exh. A § 14.5, 2000)
16.60.100 Severability.
In any section, subsection, sentence, clause or phrase of this title is for any reason to be held to be invalid, or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this title. (Ord. O-160-2000 Exh. A § 14.6, 2000)
16.60.110 Amendment.
This title may be amended or repealed as provided by law. (Ord. O-160-2000 Exh. A § 14.7, 2000)
