2.25.010 Created.

Pursuant to the authority contained in ORS 215.020, there is hereby created a County Planning Commission for Josephine County, which said Planning Commission shall be named the “Josephine County Planning Commission.” [Order 2/14/57.]

2.25.020 Members.

The Josephine County Planning Commission shall consist of seven members plus one alternate to be appointed by the Josephine County Court for four-year terms; provided, however, that the terms of the members of said Commission shall be staggered in the following manner: one member shall be appointed for one year, two for two years, two for three years and two for four years. The members of said Commission shall be residents of Josephine County, Oregon, and a majority shall reside in the unincorporated area thereof and shall serve until their respective successors are appointed and qualified. In addition to the regular members, the Josephine County Engineer, the Josephine County Agricultural Agent and the Josephine County Assessor shall be ex officio nonvoting members. 2.25.030 Designated.

The seven and one alternate member Planning Commission shall have and exercise all of the powers, duties and responsibilities contained in ORS Chapter 215. [Order 2013-007; Order 2005-021; Order 11/28/67; Order 8/25/61; Order 2/14/57.]

2.25.040 Meetings.

The Josephine County Planning Commission shall consist of seven members and one alternate appointed by the Board of County Commissioners. They shall serve for four-year terms and be residents of the County. The Board of County Commissioners may designate one or more officers of the County to be ex officio nonvoting members of the Commission.

A. The Chairman and Vice-Chairman shall be selected by the members of the Planning Commission each year at its first meeting in January.

B. Regular meetings shall be held each month on the first Thursday of the month unless otherwise approved by the membership. All meetings shall be public meetings. Special meetings may be called by the Chairman or by the request of three members. One day advance notice shall be given to all members before holding a special meeting.

C. Attendance of appointed members of the County Planning Commission at regular meetings is required. When an appointed member has failed to attend three consecutive regular meetings, unless a leave of absence has been granted by the Planning Commission, the Commission shall report the fact to the Board of County Commissioners. The Board may then proceed under ORS 215.030 to declare a vacancy in the membership of the Planning Commission and appoint a new member to serve the unexpired portion of the term of the position vacated.

D. The Planner shall prepare an agenda for each regular meeting. It shall include the business to come before the Planning Commission and matters that the Chairman desires to bring before the Commission.

E. The Planning Commission may appoint a secretary who shall keep permanent and complete records of its proceedings.

F. Committees may be appointed by the Chairman.

G. Meetings of the Planning Commission shall be conducted in a business-like manner and according to the procedure set out in “Robert’s Rules of Order.”

H. The quorum of the Planning Commission should be four members.

I. It shall be the duty and the responsibility of the Planner, to the best of his ability, to carry out the policies adopted by the Planning Commission and such other duties as may be required. He shall be a professionally trained planner and perform his duties consistent with the code of ethics established by the American Society of Planning Officials or the American Institute of Planners. 2.25.050 Powers and duties of the Planning Commission.

It shall be the function and duty of the Planning Commission to make and recommend approval of a comprehensive plan for the use of some or all of the land in the County. In preparation of the comprehensive plan, the general purpose of the plan shall be to make careful and comprehensive surveys and studies of the existing conditions and probable future growth of the County. The plan shall be made with the general purpose of guiding and accomplishing a coordinated, adjusted and harmonious development of the County which will, in accordance with existing and future needs, best promote public health, safety, morals, order, convenience, prosperity, or the general welfare, as well as efficiency and economy in the process of development.

The comprehensive plan shall be based on the standards and considerations prescribed in ORS 215.055, “Standards for Plan.”

The Planning Commission may make reports and recommendations relating to the plan and development of the County to public officials and agencies, public utility companies, civic, educational, professional, and other organizations, and citizens. It may recommend to the executive or legislative officials of the County programs for public improvements and the financing thereof. In general, the Commission shall have such powers as may be necessary to enable it to perform its functions and promote County planning.

The Planning Commission may recommend to the Board of County Commissioners ordinances intended to carry out part or all of the comprehensive plan adopted by the Commission. The ordinances may provide, among other things, for:

A. Zoning.

B. Official maps showing the location and dimensions of, and the degree of permitted access to, existing and proposed thoroughfares, easements and property needed for public purposes.

C. Preservation of the integrity of the maps by controls over construction, by making official maps parts of County deed records, and by other action not violative of private property rights.

D. Conservation of the natural resources of the County. The Commission may also recommend to the County governing body ordinances renaming public thoroughfares, numbering property, and controlling subdivision and other partitioning of land, and the location, construction, maintenance, repair and alteration of buildings and other structures.
