2.55.010 Title.
This chapter shall be known as Formation of the Josephine County Solid Waste Agency, an Intergovernmental Entity. [Ord. 2024-010 § 1; Ord. 2001-3 § 1.]
2.55.020 Ratification of formation.
The Josephine County Board of Commissioners hereby ratifies an intergovernmental entity formed pursuant to the terms of an intergovernmental agreement as amended under ORS Chapter 190. The entity is called the Josephine County Solid Waste Agency. The Josephine County Board of Commissioners has entered into an intergovernmental agreement with the City of Grants Pass and the City of Cave Junction to set out the duties, powers, and functions of the entity. 2.55.030 Effective date of intergovernmental agreement.
The effective date of the original intergovernmental agreement for formation of the Josephine County Solid Waste Agency is September 12, 2001. [Ord. 2024-010 § 1; Ord. 2001-3 § 1(B).]
2.55.040 Public purpose for which the intergovernmental entity is formed.
The public purposes for which the intergovernmental entity is formed are as follows:
A. To provide and uniformly administer solid waste franchise management services within Josephine County, including the City of Grants Pass and the City of Cave Junction;
B. To promote accountability, continuity and efficiency in the use and allocation of environmental program fees collected under solid waste franchise agreements within Josephine County, the city of Grants Pass, and the City of Cave Junction. [Ord. 2024-010 § 1; Ord. 2001-3 § 1(C).]
2.55.050 Powers, duties and functions of the Josephine County Solid Waste Agency.
The Josephine County Solid Waste Agency shall have as its function the duty and power to do the following things:
A. Provide, through a cooperative system, oversight, administration, regulation, and allocation of resources from the fees collected through solid waste franchises within Josephine County, including the Cities of Grants Pass and Cave Junction, and to conduct audits on behalf of all parties to the intergovernmental agreement.
B. Perform any functions and activities that any party to the intergovernmental agreement has the authority to perform with respect to the provision of services.
C. Perform all lawful acts that are necessary to fulfill the purposes set out above. [Ord. 2024-010 § 1; Ord. 2001-3 § 1(D).]
