3.30.010 Title.

This chapter shall be known as the Fairgrounds permanent fund. [Ord. 2024-015 § 1.00.]

3.30.020 Authority and purpose.

A. The Board of Josephine County Commissioners has authority to regulate matters of county concern within the county, under the provisions of the Constitution of the State of Oregon, the statutes of the State of Oregon, and the Charter of Josephine County.

B. The purpose of the Fairgrounds permanent fund is to be an enterprise fund that holds money in an interest-bearing account, to be accumulated and expended for the sole purpose of financing projects, property, services and equipment at the Josephine County Fairgrounds, and to provide funds to construct, acquire, repair, renovate, improve, maintain, or replace property and improvements at the Josephine County Fairgrounds, or to fund Fairgrounds operations. 3.30.030 Jurisdiction.

The Circuit Court for the State of Oregon for the County of Josephine has exclusive jurisdiction and venue over any and all violation proceedings of this chapter. [Ord. 2024-015 § 1.00.]

3.30.040 Fund established.

A. The Fairgrounds permanent fund is hereby established as an enterprise fund and designated as Fund 54.

B. The appropriation to be charged in order to provide the initial money for financing the fund will consist of money that has been received from selling the real property and improvements located at 1401 Pansy Lane, Grants Pass, Oregon.

C. The method for controlling expenditures and encumbering such funds will be the legally defined local government budget process.

D. The fund shall be an interest-bearing fund with interest automatically reinvested in the fund, unless the interest is transferred by order of the Board of Josephine County Commissioners to the recreation-fair fund (47) as needed to be available to construct, acquire, repair, renovate, improve, maintain, or replace property and improvements at the Josephine County Fairgrounds, or to fund Fairgrounds operations.

E. The value of the permanent fund may not be lower than $9,000,000. Notwithstanding the $9,000,000 minimum value, following approval from both the Board of County Commissioners and the Josephine County Fair Board, the permanent fund can loan funds to be used for a purpose described herein, regardless of whether interest is charged. Only one loan may be approved at a time and must be paid back before another loan is approved. Interest revenue otherwise gleaned by the permanent fund may be credited toward repayment of the loans.

F. No person shall expend or encumber, or authorize expenditure or encumbrance from the fund in excess of the balance of the fund, or for a purpose other than a purpose described herein.

G. The anticipated expenditures for each budget period shall be budgeted as with any other fund in accordance with law. All appropriations and expenditures from the fund shall be made in accordance with law. [Ord. 2024-015 § 1.00.]

3.30.050 Violation proceedings.

Violation of this chapter is deemed to be a public nuisance and is prosecutable as such. [Ord. 2024-015 § 1.00.]

3.30.060 Severance.

In the event that any part of this chapter shall be held by a court to be invalid or unenforceable, the remaining sections shall be unaffected and shall remain in full force and effect. [Ord. 2024-015 § 1.00.]
