PROHIBITION ON MARIJUANA FACILITIES

5.60.010 Prohibition.
No person, business, or entity may establish, maintain, or operate a marijuana facility within the city limits of the city of Junction City. The establishment, maintenance, or operation of a marijuana facility by any person, business, or other entity within the city limits of the city of Junction City in violation of this chapter is declared to be a public nuisance. 5.60.020 Definitions.
For the purposes of this chapter and in accordance with Section 134, Chapter 614, Oregon Laws 2015 (House Bill 3400), a “marijuana facility” includes:
A. Marijuana processing sites registered under Section 85, Chapter 614, Oregon Laws 2015;
B. Medical marijuana dispensaries registered under ORS 475.314;
C. Marijuana producers licensed under Section 19, Chapter 1, Oregon Laws 2015;
D. Marijuana processors licensed under Section 20, Chapter 1, Oregon Laws 2015;
E. Marijuana wholesalers licensed under Section 21, Chapter 1, Oregon Laws 2015; and
F. Marijuana retailers licensed under Section 22, Chapter 1, Oregon Laws 2015. [Ord. 1233 § 1, 2016.]
5.60.030 Violations and enforcement.
The establishment, maintenance, or operation of a marijuana facility by person, business, or other entity within the city of Junction City in violation of the requirements of this chapter will be subject to any and all enforcement remedies available to the city by law, including but not limited to abatement and penalties pursuant to Chapter 8.10 JCMC and the filing of an appropriate action and pursuit of an appropriate remedy including but not limited to declaratory or injunctive relief in a court of competent jurisdiction.
