15.06.010 Definitions.

“Demolish” means to raze, remove, destroy, or dismantle all or a part of a structure.

“Demolition” means any act or process that may cause partial or total razing, removal, destruction or dismantling of a structure.

“Minor demolition” means demolition that will generate a total of not more than three cubic yards of solid waste. (Ord. 2010-09 § 1(A))

15.06.020 Permit required.

Before any person may demolish any structure or part of a structure, such person must obtain a permit from the department of planning and community development. In addition to such other information as the director of the department of planning and community development may require, the permit applicant must provide an estimate of the amount of solid waste that will be generated by the demolition and the name and address of the site or the operator of the site to which the solid waste generated by the demolition will be taken for disposal. The disposal site must be among those approved and permitted by the Oregon Department of Environmental Quality or other governmental agency having jurisdiction. No permit is needed for minor demolition. The city council may establish by resolution a fee for a demolition permit. (Ord. 2010-09 § 1(B))

15.06.030 Proof of delivery required.

The permit holder shall submit to the city proof of delivery to a disposal site approved and permitted by the Oregon Department of Environmental Quality or other governmental agency having jurisdiction. Proof of delivery may consist of a city form provided with the permit, accompanied by receipts from the disposal site(s), or a statement sworn to upon oath or affirmation before an Oregon notary public attesting to the amount of solid waste disposed of, the date of disposal, and the name and address of the disposal site or the operator of the site. The proof of delivery shall be submitted to the city within 90 days of receiving a demolition permit, or per a schedule approved by the director of the department of planning and community development. 15.06.040 Removal of waste subject to regulation.

Removal, transport, and disposal of solid waste, including demolition materials, by a person other than the generator or producer of the waste is subject to regulation under the exclusive solid waste franchise provisions of Ordinance No. 2006-11 and Chapter 8.16 LCMC. (Ord. 2010-09 § 1(D))

15.06.050 Violation established.

The following are offenses against the city, categorized as Class B violations, and may be enforced by the city manager or any other designated officer or employee of the city who has been given enforcement authority in regards to such violations:

A. Demolition without a permit;

B. Demolition in noncompliance with any permit condition;
