CIVIL FORFEITURE

3.05.030 Distribution of funds.
3.05.010 Definition.
As used in this chapter, “prohibited conduct” includes violation of, solicitation to violate, attempt to violate or conspiracy to violate any provisions of ORS Chapter 475, except that “prohibited conduct” does not include violation of, solicitation to violate, attempt to violate or conspiracy to violate ORS 475.992(4)(f) and also does not include solicitation, attempt or conspiracy to deliver for no consideration less than five grams of the dried leaves, stems and flowers of the plant Cannabis family Moraceae. 3.05.020 Forfeiture counsel.
The Monmouth City Attorney is designated as forfeiture counsel for purposes of representing the City of Monmouth in forfeiture actions or proceedings under ORS Chapter 131A. 3.05.030 Distribution of funds.
The proceeds from property forfeited, after other distributions, shall be deposited in a forfeiture trust account and disbursed from the trust account in the manner provided in ORS 131A.090.
