CITY MANAGER

11.01 Appointment.

The Council, by a majority vote of its total membership, shall appoint a City Manager and fix the City Manager’s compensation and other terms of employment. The City Manager shall be appointed solely on the basis of executive and administrative qualifications without regard to political considerations. The City Manager may not be a resident of the City or state at the time of appointment but may reside outside the City while in office only with the approval of the Council. After taking office, the City Manager shall, at City expense, be bonded in an amount and with such surety as is approved by the Council.

11.02 Powers and Duties.

The City Manager shall be the chief administrative officer of the City and is responsible to the Council for the administration of all City affairs placed in the City Manager’s charge by or under this Charter. The City Manager shall:

11.02.1 Hire, supervise, discipline, and remove all City employees in a manner which complies with all applicable federal, state and city laws, regulations, and written policies. The City Manager may authorize any supervisor or department head to exercise these powers and duties for any subordinates in that supervisor’s or department    head’s department or office;

11.02.2 Direct and supervise the administration of all departments, offices and agencies of the City, except as otherwise provided by this Charter. Supervise the departments to the end of obtaining the utmost efficiency in each of them, but shall have no control over the judicial activities of the Municipal judge;

11.02.3 Attend all City Council meetings unless excused therefrom. The City Manager shall have the right to take part in discussions with the Council but not the right to vote;

11.02.4 See that all Charter, ordinance, code provisions, and other acts of the Council, and regulations subject to enforcement by the City Manager or by employees or officers subject to the City Manager’s direction and supervision are enforced and that the provisions of all franchises, leases, and contracts, entered into by the City and the provisions of all permits and privileges granted by the City are observed and enforced;

11.02.5 Prepare and submit to the Council an annual budget which complies with state law;

11.02.6 Keep the Council fully advised as to the financial condition and future needs of the City. Submit to the Council a complete report on the finances and administrative activities of the City as of the end of each fiscal year;

11.02.7 Supervise the operation of all public utilities and facilities owned and operated by the City and exercise general supervision over all City property;

11.02.8 Act as purchasing agent for all City departments;

11.02.9 Make recommendations to the Council concerning the affairs of the City;

11.02.10 Make such other reports as the Council may require concerning the operations of the City; and

11.02.11 Perform such other duties as the Council may require in order to implement any of the above duties.

11.03 City Manager Pro-Tem.

The City Manager shall designate a City officer or employee to exercise the powers and perform the duties of City Manager during the City Manager’s temporary absence or disability. The Council may revoke such designation at any time and appoint another officer to serve until the City Manager returns. The City Manager Pro-Tem may hire or remove City employees only with Council approval.
