1.05.010 Right to trial by jury.
Every person charged with any offense defined and made punishable by the ordinances of the city that carries the possibility of a sentence of imprisonment shall have the right to trial by jury if written notice is given to the municipal judge within six business days, excluding legal holidays, prior to the date set for trial. 1.05.020 Number of jurors.
The jury shall consist of six persons duly sworn to try the case for which they are called and selected as provided by this chapter. [Ord. 627 § 2, 1993].
1.05.030 Jury selection.
During the first regular business week of January of each year, and every four months thereafter, the court clerk shall make a jury list of citizens of the city competent under the laws of Oregon to serve as jurors in a circuit court, who shall serve as jurors in the municipal court until a new list is selected. The jury list shall be made and selected by lot from the voter registration list, and the list shall contain the names of not less than 50 such qualified persons. The court clerk shall give to each person on the jury list notice that they have been selected. [Ord. 627 § 3, 1993].
1.05.040 Trial jury.
The court clerk shall keep a secured jury box. After the jury list has been made, the court clerk shall prepare and deposit in the jury box separate papers containing the name and place of residence of each person on the jury list. At least three business days, excluding legal holidays, prior to the trial date, the defendant or the defendant’s attorney and the city attorney shall appear before the judge for the selection of the jury. The municipal judge shall designate the time and place of the selection, and so notify the defendant, the defendant’s attorney, and the city attorney. The judge shall then select, by lot, 12 names of persons from the jury list. When 12 names have been selected, they shall be notified to appear at the trial at the appointed time and place. Upon request, the municipal judge may, for good cause, excuse a juror from jury duty. [Ord. 627 § 4, 1993].
1.05.050 Peremptory challenges.
At the time and place set for the trial, the defendant and the city shall select the jury by each striking from the list three names, alternately, commencing with the defendant. The six names remaining shall constitute the trial jury. If any of the jurors are found to be disqualified by challenge for cause, their places on the jury shall be filled by drawing additional names from the jury box. [Ord. 627 § 5, 1993].
1.05.060 Verdicts.
The verdict of the jury shall be unanimous. [Ord. 627 § 6, 1993].
1.05.070 Payment of jurors.
Jurors who appear at the trial and are sworn and serve as jurors shall receive as compensation for their services the sum of $10.00 for each day of attendance. Jurors who appear at the trial and are not selected to serve as jurors shall receive as compensation for their services the sum of $5.00 for each day of attendance. [Ord. 627 § 7, 1993].
1.05.080 Costs and disbursements.
In all cases tried in the municipal court, the municipal judge may add costs and disbursements to the fine, penalty, or sentence imposed. [Ord. 627 § 8, 1993].
