WATER SHORTAGE CRISIS

13.10.010 Water shortage crisis.
At any regular or special meeting of the city council, a majority of the council present at such meeting may declare a water shortage crisis to exist if, in the opinion of said majority, the adequacy of the water supply to the city of Myrtle Creek is sufficiently endangered to create a risk of danger to the health, safety, and welfare of the people of the city of Myrtle Creek.
Any declaration of a water shortage crisis shall be by resolution, in writing, subscribed by the mayor and the city recorder, and shall state the effective date and time of such declaration. [Ord. 438 § 1, 1977].
13.10.020 Prohibited acts during a water shortage crisis.
During a water shortage crisis, the council may declare any one or more of the following acts to be unlawful, if done by any person, corporation, or other entity, with water processed by the city of Myrtle Creek:
(1) To use water to wash any building, house, garage, or other structure or part thereof.
(2) To use water to wash any car, truck, or other vehicle, except at a commercial establishment that regularly washes vehicles.
(3) To use water to moisten any driveway, sidewalk, street, alley, or other uncultivated surface of real property without specific written authorization from the city administrator of the city of Myrtle Creek.
(4) To add water to any swimming pool except a public pool or a pool at a commercial business establishment.
(5) To water any lawns, flowers, or other ornamental plants.
(6) To water any gardens or noncommercial agricultural products.
(7) To water or irrigate any agricultural crops.
Violation of this section shall be a violation of the ordinances of the city of Myrtle Creek and shall be punishable by a fine not to exceed $500.00 and imprisonment in the city jail for a period not to exceed 30 days. Each day of violation, or any violation after notice thereof, shall constitute a separate offense. [Ord. 438 § 2, 1977].
13.10.030 Emergency powers of council during water shortage crisis.
During a water shortage crisis, the council may:
(1) Impose a rate schedule by resolution for the purchase of water supplied by the city of Myrtle Creek, with higher rates for higher use. Such rate schedule shall be in writing, subscribed by the mayor and city recorder, and shall state the effective time and date of such rate schedule.
(2) Impose such other water saving measures by resolution upon the city of Myrtle Creek as, in the opinion of the council, are reasonable and necessary to protect the health, safety, and welfare of the people of the city of Myrtle Creek. Any such measure shall be in writing, subscribed by the mayor and the city recorder, and shall state the effective time and date of such measure. The willful violation of any such measure shall be a violation of the ordinances of the city of Myrtle Creek and subject to a fine not to exceed $500.00 or imprisonment in the jail of the city of Myrtle Creek, not to exceed 30 days. Each day a violation occurs, or any violation after notice thereof, shall be a separate offense. [Ord. 438 § 3, 1977].
13.10.040 Termination or suspension of water shortage crisis regulations.
At any general or special meeting of the city council, a majority of the council may declare the termination or suspension of a water shortage crisis. Any declaration of a termination or suspension of a water shortage crisis shall be in writing, subscribed by the mayor and city recorder, and shall state the effective date and time of such declaration.
