ADULT BOOK STORES AND THEATERS

5.08.020 Location restrictions.
5.08.010 Definitions.
As use in this chapter, unless the context requires otherwise, the following words and phrases shall have the meanings assigned to them:
"Adult book store" means a business activity which, expressly or by implication, advertises for the display, furnishing or sale on its premises of obscene materials as that term is defined in ORS 167.065, and openly displays such materials so as to be visible to all members of the public entering its premises.
"Adult movie house" means a theater business which in its advertising, expressly or by implication, represents its premises as a place where films or performance displayed or furnished on the premises at any time in the normal course of business are, or will be, in the absence of express notice to the contrary, an obscene performance as that term is defined in ORS 167.060.

5.08.020 Location restrictions.
No adult book store or adult movie house shall be located with one-half mile of the property line of any school, park or church.

5.08.030 Violation--Penalty.
Penalty shall be as set forth in city ordinance on infractions.
