12.20.010 Definitions.

"Public parks" mean and include all recreational properties owned and controlled by the city and available for use by the public.

12.20.020 Animals--Molesting prohibited.

No person shall in any manner pursue, kill, injure, hunt or molest any bird or animal within any park.

12.20.030 Fire restrictions.

No person shall build any fire within public parks except in a stove pit or fireplace designated for such purpose. Cooking stoves may be used within the park if in safe operating conditions and used within established picnic areas. No fire shall be left unattended and every fire shall be extinguished before its user leaves the park area. The use of fireworks is prohibited in all public parks.

12.20.040 Plants and structures--Damaging prohibited.

No person shall pick, mutilate, dig, or remove from the park any plant or plants or in any way deface or mutilate, burn, destroy, defile or remove any railing, building, seat, fence, park facility, decorative item, any other structure or tree within a park or remove from the park any logs or wood.

12.20.050 Soils and rocks--Removal prohibited.

No person shall dig up or remove any soil, rock, stones or other substances whatever, make any excavation, quarry any stone, or lay or set off any blast, or cause or assist in doing any of such things within the limits of any city park without first obtaining permission from the city council.

12.20.060 Water pollution--Prohibited.

No person shall wash any clothing or other material, nor in any way pollute any stream, pool or lake in a city park.

12.20.070 Waste materials--Disposal.

No person shall leave garbage, bottles, broken glass, tin cans, paper, litter or waste materials of any kind except in receptacles designated for that purpose. It is unlawful for any person to haul household garbage, rubbish or trash to any city park and deposit the same in the park or on public property.

12.20.080 Pets--Restrictions.

Dogs shall be allowed in all city parks, subject to the following restrictions:

A.    Dogs must be constantly supervised by their owners and must be on a leash at all times;

B.    Dog owners are responsible for picking up dog waste and taking it with them.

12.20.090 Intoxicating beverages prohibited.

No person shall have any intoxicating beverage while in or upon the property of the city park without prior consent of the city council.

12.20.100 Sign erection prohibited.

No person shall erect permanent signs, markers or inscriptions of any type within the limits of a city park without first obtaining permission from the city council.

12.20.110 Soliciting or selling prohibited.

No person while in a city park may operate a concession, either fixed or mobile, or engage in the business of soliciting, selling or peddling any liquids, or edibles for human consumption, or distribute circulars, or hawk, peddle or vend any goods, wares or merchandise, or set up or use a public address system in a city park without first obtaining permission from the city council.

12.20.120 Sports facilities rules.

The council shall set rules and fees for use of sports facilities and equipment within parks and include provisions for reserved use of sports facilities. Unless reserved under the rules, no person or group shall monopolize any area of a park or sports facility. Neither shall any person or group interfere with the lawful activities of other park patrons.

12.20.125 Use of Colver Road Ball Field and city park.

A.    Any and all playing of hardball baseball or hardball baseball activity of any kind at the Colver Road Ball Field or the city park is prohibited. All players using the Colver Road Ball Field or city park are responsible for any damage to the Colver Road Ball Field, the city park or surrounding properties.

B.    Softball baseball or softball baseball activity is allowed providing such playing or activity is limited to the current softball field facility only, including, but not limited to, batting practice.

12.20.130 Public park hours.

No person shall enter or park a vehicle in a park or loiter in city parks from sunset to sunrise. The city council may alter the hours of use for any park or recreational facility.

12.20.140 Camping--Designated area use.

No person shall camp overnight except in areas designated for camping except by permission for youth groups, whose leaders will acquire the permission from the city council in advance.

12.20.150 Firearms--Discharge prohibited.

No person, other than a law enforcement officer, shall bring into any city park any firearm unless the firearm is left in a vehicle, which shall be secured at all times and parked in a parking area.

12.20.160 Throwing objects prohibited.

No person shall use golf clubs, archery equipment, discus, javelin, shot put, model aircraft, or lawn darts except as permitted by the city council.

12.20.170 Vehicle restrictions.

No automobiles, trailers, motorcycles or other motorized vehicles shall be operated, stopped, parked or left standing any place in a public park except in areas provided, maintained or designated for such purposes.

12.20.180 Parking area use.

Parking areas within parks shall be for the exclusive use of park patrons while they are in the park. The use of parking areas by persons while at their place of employment; for employee or customer parking; for performing or offering to perform any business or service for pay; for the storage, holding, servicing, repairing, painting, washing or other work on any vehicle, except for emergency service for an occurrence during lawful use of the park; or while pursuing any other activity outside the park is strictly prohibited.

12.20.190 Damage responsibility.

All persons using any park will be held responsible for any damage they cause. Parents will be held responsible for the conduct of their children, whether or not a parent is present.

12.20.200 City liability limitations.

The mayor and council will not be held responsible for accidents, injuries or loss of property by fire, theft, wind, floods or other natural acts. Equipment furnished on the grounds is solely for the convenience of persons using any park and is used at their own risk.

12.20.210 User fees.

The city council or appointed designee, shall set fees as it deems necessary for social use or limited exclusive use of any city park grounds, buildings or equipment.

12.20.220 Enforcement of ordinances.

All ordinances of the city shall apply to and be in full force and effect within the city parks.

12.20.230 Temporary suspension of ordinance.

For public purpose or an event, the city council may, by motion, declare any portion of any ordinance to be temporarily in-applicable to the city parks.

12.20.240 Applicability to city employees.

The provisions of this chapter shall not apply to city employees or other authorized personnel acting within the scope of their employment and under the authority of the city council.

12.20.250 Violation--Penalty.

Any person, firm or corporation who violates any provision of this chapter shall be guilty of committing an infraction. The penalty for committing an infraction shall be a fine, not to exceed five hundred dollars. Refer to Chapter 1.20, General Penalty of this Municipal Code.
