GARAGE SALES

5.20.010 Definitions.
The following definitions are adopted for the purpose of this chapter:
“Garage sale” or “yard sale” is an aspect of residential uses consisting of sales on the premises of a dwelling by the residents of the dwelling for the purpose of disposing of their surplus clothing, furniture or other household items. [Ord. 93-226-O § 1].
5.20.020 Permitted use.
Garage sales and yard sales, hereinafter referred to in this chapter as “sales,” are permitted, provided they comply with the standards set forth in this chapter. [Ord. 93-226-O § 2].
5.20.030 Length of sales.
Sales may be no longer than three continuous days. [Ord. 93-226-O § 3].
5.20.040 Frequency.
Sales may be held no more than four times per calendar year per household. [Ord. 93-226-O § 4].
5.20.050 Site permission.
A. Sales shall be conducted on property which is regularly occupied by the person conducting the sale.
B. Multiple family sales are permitted if the sales are held on the property of one of the participants.
C. Sales may not occur or encroach upon city streets, sidewalks, or other rights-of-way. [Ord. 93-226-O § 5].
5.20.060 Signs.
A. Signs may be placed on another’s property with the property owner’s permission.
B. Signs may be no larger than three square feet each.
C. Signs may not be placed on telephone or utility poles or street signs.
D. Illegally placed signs will be removed by the city at the owner’s expense.
E. Signs may be placed on city rights-of-way provided they are outside the travel and parking portions of a roadway and do not obstruct or impair vision or pedestrian traffic on a sidewalk. Sidewalk clearance of at least four feet shall be maintained at all times.
F. All signs shall be located so that they do not obstruct or impair vision clearance, do not impair pedestrian traffic, and do not impair vehicular traffic.
G. All signs must be removed by the end of the day of the sale. [Ord. 23-419-O §§ 1 – 3; Ord. 08-356-O § 1; Ord. 93-226-O § 6].
5.20.070 Permit required.

5.20.080 Penalties.
A. A person who violates any provision of this chapter may be prosecuted in municipal court.
B. A violation of this chapter shall be punishable by a fine not less than $50.00 nor more than $1,000. [Ord. 23-418-O § 20; Ord. 93-226-O § 8].
