8.08.010 Establishment.

An environmental management committee (EMC) is hereby established for the city. (Ord. 21-07 § 1, 2021; Ord. 19-07 § 1 (Exh. A), 2019; Ord. 17-05 § 1, 2017; Ord. 15-09 § 1, 2015).

8.08.030 Membership.

The EMC shall consist of seven voting members to be appointed by the mayor with the advice and consent of the city council. At least one member shall be an elected member of the city council. Five citizen members shall be residents of the city and one citizen member may reside outside city limits. If possible, one citizen member shall be a high school student. If the high school student cannot be appointed, that position may be filled by a resident of the city. The council and citizen members serve at the pleasure of the city council and may be removed by the council with or without cause. Appointments to fill a vacancy for one of the citizen member positions shall be made for the remainder of the unexpired term of that member. The person or firm granted an exclusive franchise by the solid waste ordinance for providing solid waste services in the city (the hauler) and the public works director shall serve as ex officio (nonvoting) members of the EMC and shall receive notice of meetings. 8.08.050 Term of office.

The citizen members shall be appointed for a term of three years. The term of the high school student shall be one year, from July 1st to June 30th. 8.08.070 Meetings.

A majority of the members of the EMC shall constitute a quorum. The EMC will not have regularly scheduled meetings and will only meet as necessary to handle matters referred to it by the city council, the public works director, or the city manager. At its first meeting, the EMC shall select a chair and a vice chair. Any member of the committee is eligible to serve as either the chair or the vice chair. At its first meeting after the beginning of each new calendar year, the election of a chair and vice chair for that calendar year will be the first order of business. The chair, and in the chair’s absence, the vice chair shall preside over all meetings. All meetings of the EMC shall be held in compliance with the Oregon Public Meetings Law. 8.08.090 Duties.

The EMC is an advisory committee and does not have any policy making authority. It shall perform the following duties when requested to do so by the city council, public works director, or the city manager:

A. Develop and recommend to the council strategies, informing the public, and advising the city council on fulfilling the public policies set out in the solid waste ordinance.

B. Recommend to the city council strategies for promoting and developing recycling, waste reduction and reuse.

C. Make recommendations to the city council on any rate adjustment or service level adjustment requested by the hauler.

D. Advise the city council on environmental and health issues.

E. Advise the city council on sustainability issues and practices with regard to solid waste, building maintenance and construction, energy and water conservation, and green purchasing guidelines.

F. When delegated to do so by the city council, hear complaints about the hauler’s services under its exclusive franchise. Any other similar matter or issue referred to the EMC by the city council.
