12.05.010 Definitions.
As used in this chapter, the following mean:
“Improvements” means all improvements on a site, including buildings, placement, or replacement of manufactured or other structures, infrastructure, parking and loading areas, landscaping, paved or graveled areas, grading, and areas devoted to exterior display, storage, or activities. “Improvements” do not include natural geologic forms or landscapes.
“Person” means a natural person, firm, corporation, or other legal entity.
“Public works” or “public improvements” include, without limitation, all portions of the city’s streets, sidewalks/trails, parks, sanitary sewer, storm sewer, water systems, and any other construction within or related to city systems, property, rights-of-way, easements, and/or facilities.
“Public works standards and specifications” means the public works construction standards for the city of Sisters publication dated February 2014, as may be amended or restated from time to time pursuant to the provisions of this chapter. [Ord. 503 § 2 (Exh. A), 2020].
12.05.020 Adoption of public works standards and specifications.
The city of Sisters hereby adopts the regulations and standards set forth in the public works standards and specifications. A copy of the city of public works standards and specifications is available at City Hall and at the public works department. [Ord. 503 § 2 (Exh. A), 2020].
12.05.030 Amendment of public works standards and specifications.
Any provision of the public works standards and specifications may be amended or restated by resolution of the city council. The city engineer may amend technical provisions and standards of the public works standards and specifications. Public notice of technical amendments shall be posted in City Hall no less than 30 days prior to the effective date of the amendments. [Ord. 503 § 2 (Exh. A), 2020].
12.05.040 Public improvement construction standards.
All public works and public improvements must be designed and constructed in accordance with the public works standards and specifications. The requirement to comply with the public works standards and specifications also applies to improvements constructed by or for the city and to improvements constructed by or for contractors, developers, or property owners. 12.05.050 Violations declared a nuisance.
Any violation of the public works standards and specifications is a nuisance and, in addition to any other remedy available to city, may be abated as provided in Chapter 8.15 SMC. [Ord. 503 § 2 (Exh. A), 2020].
12.05.060 Penalty.
Any person violating any provisions of this chapter is punishable by a fine not to exceed $500.00. Every violation and each day that such violation persists is a separate violation. The remedies specified in this section shall not be deemed exclusive and, at the option of the city, the city may seek any other remedy available at law or equity including, without limitation, an injunction in any court of competent jurisdiction in the state to enjoin any violation of this chapter. The violator will be responsible for city’s attorney fees and costs. [Ord. 503 § 2 (Exh. A), 2020].
