CONSTRUCTION RIGHT-OF-WAY PERMITS

12.24.010 Permit – Required.
All construction activity of any kind where work is to be performed in a city right-of-way requires a right-of-way construction permit. Such permit is required by any person, firm or corporation performing such work. (Ord. 2637 § 1, 1992)
12.24.020 Permit – Application.
The application shall be filed with the public works department with plans required at submission. The application is to be reviewed and approved by the city prior to any work being performed. The city may require an engineer’s certificate for plans submitted. (Ord. 2637 § 2, 1992)
12.24.030 Permit – Fee.
There is no fee or charge for the permit or engineering plans review. (Ord. 2637 § 3, 1992)
12.24.040 Construction regulations.
Only city approved materials and methods will be used and permit holders must comply with all laws, rules, regulations and ordinances that apply to such work. (Ord. 2637 § 4, 1992)
12.24.050 Exceptions.
Such permit is not required where such right-of-way work is reviewed and approved by the city under another permit. A permit is not required for any work done by the city. (Ord. 2637 § 5, 1992)
12.24.060 Inspection.
All work must be inspected and a minimum of 24 hours’ notice shall be provided to the city for inspection of any approved project. Where an emergency arises and work must be performed on a weekend or day that city staff is unavailable, work may be performed without prior authorization. However, a permit must be obtained by 5:00 p.m. of the next working day. (Ord. 2637 § 6, 1992)
12.24.070 Violation – Penalty.
A violation of this chapter is punishable by a stop work order as issued by the city building official of the public works director. (Ord. 2637 § 7, 1992)
