2.08.010 Form of government.

Eagle Mountain City is a six-member council form of government. The powers of municipal government in Eagle Mountain are vested in the city council consisting of six members, one of which is the mayor. All legislative, executive, and administrative powers are held by the six-member city council. [Ord. O-12-2024 § 2 (Exh. A)].

2.08.020 Legislative powers.

The city council shall exercise its legislative powers through ordinance. [Ord. O-12-2024 § 2 (Exh. A)].

2.08.030 Council administration.

No one member of the six-member council shall make decisions for the body nor shall any member of the body knowingly give the perception to an organization, or individual citizen, or staff that they are authorized to represent the full body without the city council’s vote and approval in an open and public meeting. 2.08.040 Executive powers.

A. Except as otherwise provided for in the Eagle Mountain Municipal Code, the executive powers of the mayor shall be in accordance with the municipal code (see EMMC 2.10.010). The mayor’s executive powers, duties, and functions are limited to those found in the Eagle Mountain Municipal Code, Eagle Mountain City policies and procedures, and resolutions adopted by the city council.

B. The mayor shall take care that the laws of Eagle Mountain City are faithfully executed. The mayor shall not veto or prevent the execution of an ordinance, policy, resolution, or request by the majority vote of the body of the city council, by verbal or written communication, action, inaction, implication, or intimidation of staff. 2.08.050 Staff powers.

City staff of Eagle Mountain shall follow the Eagle Mountain Municipal Code, resolutions adopted by the city council, and all policies found in the policies and procedures manual. Staff shall not enter into or renew a contract or agreement, except as allowed by the municipal code or as directed by city council after a vote in an open and public meeting. Staff shall not give the perception to an organization or individual citizen that they represent the full body of the council without the city council’s vote and approval in an open and public meeting. 2.08.060 Adoption of policies.

No new city policies, code, ordinance, or resolution shall be created and enacted by mayor or staff without the consent of the majority vote of city council in an open and public meeting. [Ord. O-12-2024 § 2 (Exh. A)].
