10.20.010 Definitions.

A. “Off-highway vehicles” or “OHV” means any all-terrain type I or type II vehicle or motorcycle.

B. “All-terrain type I vehicle,” “all-terrain vehicle type II” or “ATV” means any motor vehicle as defined in Section 41-22-2, Utah Code Annotated, as amended.

This term does not include golf carts, any vehicle primarily designed to carry a disabled person, any vehicle not specifically designed for recreational use or farm tractors as defined under Section 41-1a-102, Utah Code Annotated.

C. “City” means Eagle Mountain City, Utah.

D. “Motor vehicle” means every vehicle which is self-propelled.

E. “Operate” means to be in actual physical control of an off-highway vehicle.

F. “Operator” means the person who is in actual physical control of an off-highway vehicle.

G. “Owner” means a person, other than a person with a security interest, having a property interest or title to an off-highway vehicle and entitled to the use and possession of that vehicle. [Ord. O-06-2012 § 1].

10.20.020 Driver’s license required.

Every person operating an off-highway vehicle in Eagle Mountain City on public streets or trails must be a licensed driver under the laws of the state of Utah. [Ord. O-06-2012 § 2].

10.20.030 Driving on paved public trails or closed public streets.

Off-highway vehicles shall not be operated on paved public trails or on the following classified closed public streets except as specifically authorized herein:

Utah SR 73; Ranches Parkway; Eagle Mountain Boulevard from the intersection of SR 73 to the east right-of-way line of the intersection of Eagle Mountain Boulevard and Pony Express Parkway; Pony Express Parkway. Off-highway vehicles may cross closed classified public streets only at authorized points of crossing designated by the city on Exhibit 1 attached to the ordinance codified in this chapter and as further defined below. Pony Express Parkway may be used as a designated OHV crossing by off-highway vehicles along the section from Lone Tree Subdivision south to the intersection of Pony Express Parkway and Lake Mountain Road. 10.20.040 Equipment required.

An OHV operated within Eagle Mountain City shall be equipped as required for registration under Utah State law. [Ord. O-06-2012 § 4].

10.20.050 Speed limit.

Off-highway vehicles operated on the streets of Eagle Mountain City shall not be operated in excess of 20 miles per hour. [Ord. O-06-2012 § 5].

10.20.060 Passengers.

All passengers on an off-highway vehicle shall ride on a seat which is designed and intended for the use of passengers to the rear of the operator. [Ord. O-06-2012 § 6].

10.20.070 Compliance with state statutes.

Every OHV operated on public streets or trails must comply with the laws of the state of Utah and nothing in this chapter shall be interpreted to amend or modify the laws of the state of Utah. OHV use is not permitted on private property without the permission of the landowner. [Ord. O-06-2012 § 7].

10.20.080 Violation – Penalty.

It is unlawful to operate an OHV in violation of the laws of the state of Utah and the provisions of this chapter. Any person that violates any provision of this chapter is guilty of a Class B misdemeanor. [Ord. O-06-2012 § 8].
