BOARD OF ADJUSTMENT

2.90.010 Created.
As allowed by Utah law, there is hereby created a Board of Adjustment, which shall consist of three members. There may also be appointed one nonvoting alternate member to vote when a regular member is absent or unable to vote due to a conflict of interest. Members shall be appointed by the Mayor with the advice and consent of the City Council. All members of the Board of Adjustment shall reside within the City limits. 2.90.020 Term of office.
Each member of the Board of Adjustment shall serve for a term of three years starting in January and ending in December or until a successor is appointed. Members of the Board so appointed shall be such that the term of one member shall expire each year. Vacancies shall be filled in the same manner as the original appointment for the balance of any unexpired term. (Ord. 2016-09 § 1, 2016; Ord. 66 § 4.3.1, 1993.)
2.90.030 Organization.
The Board of Adjustment shall organize and elect a Chair and follow standard rules of meeting procedure. (Ord. 2016-09 § 1, 2016; Ord. 66 § 4.3.3, 1993.)
2.90.040 Meetings.
Meetings of the Board of Adjustment shall be determined by the City in a manner that satisfies the workload of the Board and any appropriate state laws. (Ord. 2016-09 § 1, 2016; Ord. 66 § 4.3.4, 1993.)
2.90.050 Hearings before the Board of Adjustment.
The Board of Adjustment is created to hear requests for variances only. All hearings shall comply with standards and procedures for appeal authorities set forth in state law. (Ord. 2016-09 § 1, 2016; Ord. 66 § 4.3.5, 1993.)
2.90.060 Judicial review of Board of Adjustment decisions.
An adverse decision by the Board of Adjustment may be appealed to district court pursuant to Utah law. (Ord. 2016-09 § 1, 2016; Ord. 66 § 4.3.6, 1993.)
