Every person acting with the mental state required for the commission of an offense, who directly commits the offense, who solicits, requests, commands, encourages or intentionally aids another person to engage in conduct which constitutes an offense shall be criminally liable as a party for such conduct. (Section 76-2-202, Utah Code Annotated 1953) [Code 1988 § 1-4-4.1].
1.20.020 Liability of officers.
No provision of this code designating the duties of any officer or employee shall be so construed as to make such officer or employee liable for any fine or penalty provided for a failure to perform such duty, unless the intention of the particular section to impose such fine or penalty on such officer or employee is specifically and clearly expressed in the section creating the duty. [Code 1988 § 1-4-4.2].
