2.30.010 Attorney to be retained.

The city council shall retain an attorney duly admitted and licensed to practice law in the state of Utah to serve as city attorney and as legal advisor to the city council and to city officers and employees on matters pertaining to their duties; to represent the city in litigation except where the city council directs otherwise; and to render such other legal services as may be required by the city council. (Section 10-3-901, Utah Code Annotated 1953) [Code 1988 § 2-7-1].

2.30.020 Attendance at meetings.

The attorney shall attend city council meetings and other meetings when requested to do so by the mayor or by any member of the city council. [Code 1988 § 2-7-2].

2.30.030 Legal advisor.

The city attorney shall render advice on all legal questions affecting the city whenever requested to do so by any city official. Upon request by the mayor or by any member of the city council, he shall reduce any such opinion to writing. [Code 1988 § 2-7-3].

2.30.040 Drafting ordinances.

It shall be the duty of the attorney to draft or supervise the drafting of all contracts, leases, or other documents or instruments to which the city may be a party; and upon request of the city council, to draft ordinances covering any subject within the power of the city. [Code 1988 § 2-7-4].

2.30.050 Legal representation.

The city attorney shall prosecute or defend any and all suits or actions to which the city may be a party, or in which it may be interested, or which may be brought against, or by, any officer of the city on behalf of the city. [Code 1988 § 2-7-5].

2.30.060 Prosecutor.

The city attorney shall have the duty to prosecute violations of city ordinances and shall have the same powers in respect to violations of city ordinances as may be exercised by a county attorney in respect to violations of state law, including, but not limited to, granting immunity to witnesses for violations of city ordinances. 2.30.070 Judgements.

It shall be the duty of the attorney to see to the full enforcement of all orders, judgements, and decrees rendered or entered in favor of the city. [Code 1988 § 2-7-7].

2.30.080 Condemnation and special assessment proceedings.

It shall be the duty of the attorney to see to the completion of all special assessment proceedings, condemnation proceedings and similar actions. [Code 1988 § 2-7-8].
