Article I. Generally
10.10.010 Speed limits.
A. When appropriate traffic control or regulatory signs giving notice of speeds are posted, the maximum speed limits designated upon said signs shall apply to the appropriate streets or portions of streets so posted.
B. In the absence of any speed limit sign designating a speed limit applicable thereto, the speed limit shall be 25 miles per hour. [Ord. 2004-1. Code 1988 § 8-2-1].
10.10.020 Traffic control.
The traffic control and regulation of all public streets shall be posted, regulated or controlled by appropriate traffic control devices, signs or other regulatory devices or controls. [Ord. 2004-1. Code 1988 § 8-2-2].
10.10.030 Stop and yield intersections.
When appropriate traffic control or regulatory signs are posted at entrances to intersections identifying them as stop or yield entrances, such streets are hereby declared to be stop entrances as designated by the signs. [Ord. 2004-1. Code 1988 § 8-2-3].
10.10.040 Blocking streets or highways.
In addition to the parking provisions contained in the traffic code as adopted by Chapter 10.05 HMC, it shall be unlawful for any person to:
A. Remain standing, lying or sitting on any street or highway in such a manner as to obstruct the free passage of vehicular or pedestrian traffic thereon.
B. Willfully remain standing, lying or sitting on any street or highway in such manner for more than one minute after being requested to move by any police officer.
C. Willfully remain on such street or highway in such manner as to obstruct the free passage of any person or vehicle into or out of any property abutting upon the street or highway or any property having access to such street or highway. [Ord. 2004-1. Code 1988 § 8-2-4].
10.10.050 Pedestrians prohibited in underpass.
It shall be unlawful for any pedestrian to walk in or on the street portion of the underpass on Janet Street between Main Street and Welby Street. [Ord. 2004-1. Code 1988 § 8-2-7].
10.10.060 Penalties.
Except as may be otherwise provided herein, violation of any provisions of this chapter shall be a class B misdemeanor. At the enforcement officer’s sole discretion, a violation of this chapter may be handled as a civil violation under HMC Title 11, a criminal violation as stated herein, or both. The civil penalty shall be $100.00 per day. [Ord. 2018-1; Ord. 2004-1. Code 1988 § 8-2-8].
Article II. Unlawful Parking
10.10.070 Parking at curb.
No motor vehicle shall be parked with the left side of the vehicle next to the curb, except on one-way streets. It shall be unlawful to stand or park any motor vehicle in a street other than parallel with the curb and with the two right wheels of the vehicle within 12 inches of the regularly established curb line except on those streets which have been marked for angle parking; then vehicles shall be parked at the angle to the curb indicated by such marks. 10.10.080 Vehicles for sale.
It shall be unlawful to park any vehicle on any street for the purpose of displaying it for sale, or to park any vehicle from which merchandise is peddled on any business street. [Ord. 2004-1. Code 1988 § 8-2-5.2].
10.10.090 Parking prohibited.
It shall be unlawful for any person to park any motor vehicle on any street in violation of the posted restrictions; provided, that this restriction shall not apply to physicians on emergency calls or designated emergency vehicles when properly posted. [Ord. 2004-1. Code 1988 § 8-2-5.3].
10.10.100 Storage of vehicle on public streets prohibited.
It shall be unlawful for any person to park or leave standing on any public road, street, alley, or municipal property, any unlicensed trailer, cycle, recreational vehicle, boat, mobile home, or other motor vehicle.
Any such camper, boat or other vehicle which registration is expired 90 days or more may be removed and impounded by the city. All costs for the removal and impoundment of said vehicle shall be charged to the owner or any person who claims the impounded vehicle and shall be paid prior to the release thereof. [Ord. 2004-1. 10.10.110 Parking at underpass.
It shall be unlawful for any person to stop or park any vehicle in the underpass on Janet Street, between Main Street and Welby Street, except in case of emergency or to avoid an accident. [Ord. 2004-1. Code 1988 § 8-2-5.5].
10.10.120 Overnight parking on city streets during winter season prohibited.
A. To facilitate the efficient and safe removal of snow from city streets, it shall be unlawful for any person to park or leave standing on any public road or street, any licensed or unlicensed automobile, camper, trailer, cycle, recreational vehicle, boat, mobile home, or other motor vehicle from October 1st to March 1st of each year when there is an accumulation of snow in excess of two inches or when city snow removal units are on city streets. This provision shall apply to all streets within Helper City with the exception of the business district referred to below.
As to the business district of Helper City (that area on Main Street between Locust Street and Janet Street), it shall be unlawful for any person to park or leave standing any licensed or unlicensed automobile, camper, trailer, cycle, recreational vehicle, boat, mobile home, or other motor vehicle between the hours of 2:00 a.m. and 7:00 a.m. from October 1st to March 1st of each year when there is an accumulation of snow in excess of two inches or when city snow removal units are on Main Street in the business district.
B. The mayor or chief of police may, at his discretion, in cases where large amounts of snow have accumulated within Helper City, declare a “snow removal state of emergency.” Once the state of emergency has been declared, the mayor or chief of police shall cause a posting of the declaration on the front door of City Hall and also attempt notification through a local radio station or other news media location.
C. The mayor or chief of police shall dictate in his posting and other broadcast what restrictions have been put in place which they determine necessary. In cases of an emergency, vehicles may be prohibited from parking on any city street any time of the day for any length of time determined by the mayor or chief of police or other restrictions they determine necessary to facilitate the efficient and safe removal of snow.
D. Whenever a snow removal state of emergency has been declared, vehicles not moved after a reasonable effort has been made to contact the owner may be removed and impounded by the city with all costs for the removal and impoundment of said vehicle charged to the owner or any person who claims the impounded vehicle and shall be paid prior to the release thereof. 10.10.130 Overnight parking or camping.
In order to facilitate tourism and special events within Helper City, overnight parking or overnight camping is permitted in areas specifically designated for such activities.
No person shall park or camp overnight in a designated area without first obtaining a permit from the city and paying the fee established by city resolution.
A violation of this section is a class B misdemeanor. Each day of violation shall constitute a separate offense.
At the enforcement officer’s sole discretion, a violation of this chapter may be handled as a civil violation under HMC Title 11, a criminal violation as stated herein, or both. The civil penalty shall be $100.00 per day. [Ord. 2018-1; Ord. 2010-4. Code 1988 § 8-2-9].
Article III. Parking in Central Business Area
10.10.140 Parking zone established.
The following portion of Main Street in Helper, Utah, is hereby established as a parking zone: The east and west sides of Main Street between the U.S. Post Office Building and Poplar Street. [Ord. 2004-1. Code 1988 § 8-2-6.1].
10.10.150 Parking spaces.
The chief of police of the city of Helper shall have lines or markings painted upon the curb or street adjacent to each parking space within the parking zone designating the area within which an automobile may be parked. It shall be unlawful to park any vehicle across any such lines or markings, or to park a vehicle in such a position that it shall not be entirely within the space designated by such lines or markings.
Violation of this section shall be punishable as an infraction. [Ord. 2004-1. Code 1988 § 8-2-6.2].
10.10.160 Overtime parking.
It shall be unlawful for any person living and/or residing in any apartment or temporary housing within the parking zone with the exception of motels or hotels to cause, allow, or permit, or suffer any vehicle registered in his name or operated or controlled by him to be upon any parking space within the parking zone for more than 10 consecutive minutes between the hours of 7:00 a.m. and 6:00 p.m. of any day, Sundays and legal holidays designated by the city council excepted. The owner or operator causing, allowing, permitting, or suffering any vehicle to be upon the street within the parking space within the parking zone shall be deemed prima facie to be the person in whose name the said vehicle is licensed and registered by the state of Utah, or any other state as evidenced by the license thereon, unless the person in whose name the vehicle is registered was not the operator of the said vehicle at the time or place of the alleged violation.
Violation of this section shall be punishable as an infraction. [Ord. 2004-1. Code 1988 § 8-2-6.3].
